So im in a bit of peculiar situation... me and my husband applied for a mortgage at the beginning of July, having checked free score and Experian with good records. The mortgage company rejected and said there was an adverse credit risk and I was asked to check Equifax. This immediately flagged a default with a company called Hoist, dated June 2015... they seem quite famous on this forum and not in a good way.
I asked Equifax to dispute it as its not anything to do with me, but hoist rejected that as they believe the debt to be true and the default remains.
Ive contacted Hoist to provide me the credit agreement & statements. The default relates to a Barclaycard from June 2007, which I did not open. At the time I lived in a house share and so could be a house "mate" or one of their friends, boyfriends etc, who would have had easy access to anything they needed to get hold of. But we will never know as Hoist have been unable to provide me with a copy of the agreement, meaning that I cannot prove the fault. They acknowledged my request on the 14th July, but no sign of any agreement or statement. I think at this point it is unlikely they will find it, 2007 is before digital archiving etc.
So what do I do? I cant get a mortgage with this default on my file. My credit score on Experian has no issues, and with the exception of this default my Equifax is fine, so the default can be seen as very out of my character. Are there any legal routes I can go down to get it removed? Is there any onus on Hoist to remove it? Can I negotiate and pay for it to be removed, it would be worth it if it means we can buy a house although I disagree with the principle of it. Please help!!!!!

Chase Hoist up and if they can't prove it, tell them to remove it.
Check where the default appears (out of the three CRAs). You want it removed from all. Ignore your credit scores - they don't tell you anything.
Finally, if you can't get it removed, don't think that you can't get a mortgage with a three year old default, especially if you satisfy it. You just need to know where to place your application.0 -
Do they have to remove it? I have asked Equifax to request the removal again.
I have two mortgage brokers and both seem to be struggling. We only have a 10% deposit and so not enough for a high risk mortgage is the feedback Im getting.0 -
If it's inaccurate, yes, they need to remove it.
Are you using proper mortgage brokers or ones out of the back of estate agents? Are they experience in adverse credit?0 -
Weve used L&C in the first instance and then a family member recommended a financial advisory company.0

Further background... we are first time buyers, my husband is self employed I am full time, and we have 2 children in nursery.0

Ditch L&C. They're a factory line that can't deal with anything other the simplest of cases.0
