Parking Charge Notice (PCN)

Hi All,
I have 2 PCN from a work car park (Private Land) through the post. 1 for not parking in a marked parking bay and another for not displaying permit.
Notices in work is new.
The one for not parking in a marked parking bay, there is an area allocated where we can park and there are no marked bays BUT I parked next to the curb (I thought I was allowed to park there
)
The other one they are saying I didn't have my permit displayed, every morning I put the permit in the dash.. (But I can't see from the picture if there is a permit). I can see a white 'thing' on the dash but can't quite see - could be sunlight..??
Is there a way to appeal or if I don't pay will it 'go away'?? I'd rather deal with it via appealing if I can than to just chance it and hope it goes away.. especially with my luck lately!:(
Any advice would be great.

The NEWBIES FAQ sticky, post #1 will start you on the process. There is a ready written initial appeal - one size fits all, use it without any additions or edits. You need to appeal each ticket separately.
Tell us which parking company please, because beyond the initial appeal advice will differ depending on who they are. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No further info needed.
3D are small fry operators and AOS members of the IPC. So, standard advice for IPC operators is to make the initial appeal, then ignore anything else they or their debt collectors send you, but don't ignore a LBC or MCOL (see NEWBIES FAQ sticky, post #5 for acronyms).
They are not at all litigious at present, so this may never proceed any further, but they do have 6 years to issue proceedings, so we can't give any guarantees extending to 2024.

Umkomaas.. I'll have a proper read of the link you sent me. On what basis am I appealing the PCN?
The one that says permit is not clear.. I can see something on the dash but can't clearly see if its sunlight or permit. If they can't prove the 'white image' is not permit. Do they have grounds for that PCN. I'd rather try and get one squashed than wait for something to land in 6 years time :rotfl:0 -

You're appealing on the basis of what's in the initial appeal. The 'why' is detailed in the sticky, but in short, no matter what you put in your appeal will cause the PPC to cancel - nothing! The danger is that you put something in your appeal that makes you more vulnerable to them (you blow off some of your toes by writing stuff that doesn't help you), so you stick exactly to the script.Umkomaas.. You are essentially going through the motions of entering communications to show that you've engaged in their process to try to resolve this - something that will be in your favour should this get to court (which, as things stand, is unlikely).
I'm afraid you're in this for the long run. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Is this ok..
I am writing to you as keeper of the vehicle and note the contents of your letter. This debt is denied.
Your letter does not comply with the Protection of Freedoms Act (PoFA) 2012 as it was not served within the 14 days as required under Schedule 4 of the Act. As such, you cannot invoke keeper liability and you must now take the matter up with the driver.
As there is no legal obligation to name the driver I decline to do so. You may not make any assumption on this.
Please do not contact me again except to confirm the PCN in cancelled.0 -
Why have you decided not to use the already written appeal supplied in post #1 of the NEWBIES FAQ sticky thread?0
