Gladstone Claim - Help needed on Steps

    We act for the Claimant and have notified the Court of our Client’s intention to proceed with the claim.



    Please find attached a copy of our Client’s completed Directions Questionnaire, which will be filed with the court upon their request. You will note we intend to request a special direction that the case be dealt with on the papers and without the need for an oral hearing



    This request is sought simply because the matter is in our Client’s opinion relatively straightforward and the costs incurred by both parties for attending an oral hearing would be disproportionate.



    You will note our Client has elected not to mediate. Its decision is not meant to be in any way obstructive and is based purely on experience, as mediation has rarely proven beneficial in these types of cases. Notwithstanding this, our Client would be happy to listen to any genuine payment proposals that you wish to put forward.

    Indeed, either get a grip and realise this isnt going away, or pay up and fund them to abuse vulnerable people who cant just pay up to get rid of it.

    I had my hearing today.

    I had the strangest experience, the judge started off very angry, discrediting anything I say, while defending the other party whom were absent. Gladstone provided a witness statement.

    Before me were two more cpm cases and they both lost and had to pay up, not sure if it were full amount.

    Gladstones defence was organised and strong, but I pleaded using their witness statement against them.

    The hearing has been adjourned and I have two weeks to provide 'amended defence' and witness statement. Thereafter Gladstones will have another 2 weeks to respond to my defence.

    What did the Judge say was wrong with your defence?

    Did you muck up and not provide ANY evidence or WS, totally against what the NEWBIES thread tells you that you must do?

    It is worrying that you disappeared in October, despite the NEWBIES tread telling you about the next stages and that 'DEFENCE IS NOT YOUR ONLY JOB'.

    Which court and judge?

  • It's very hard to tell what went down.

    *please have the confidence to make notes or ask the judge repeat him/herself if needed* they are pressed for time and often don't hang about, but are rarely totally inhuman! It cuts both ways too - the judge asked me to slow down when I ripped into the PPC's case.

    If the o/p doesn't know what went down, it's hard to second guess. There are probably 2 distinct possibles here:

    1. Arguing meritorious points, but which were not referred to in the defence (at all)

    2. A judge p1ssed off with a template defence which, on questioning the defendant didn't much understand either.
