If there is a gate, it might not be a public place?
If the gate is broken, does that mean it is no longer private?

Indeed. They have probably taken the view that it is not a public place. They may be right. As I said in post #8 that is ultimately a matter for the courts to decide.
Whether it is worth going to the High Court over a £240 dispute is a mettaer for the OP.0 -
