    It can depend on the authority to access the location.
    As in your quote, plenty of private locations can be considered to be a 'public place' as the public have the authority to access them, but not all private locations give the public that authority.


    If the authority to access is restricted - eg. Residents Only car parks, private driveways etc., it may not be considered to be a 'Public Place'.

    If the public have access, how can it be private?
    If there is a gate, it might not be a public place?
    If the gate is broken, does that mean it is no longer private?
    If the Dartford river crossing is shut does it cease to be a road?

    It is the authority to access, not the ability to access that is relevant.


    A gate is not always relevant, a public place may have a gate, a private place may not.

    Without seeing the OPs car park, I would suggest it is pointless to speculate.

    As I have shown, private land can and often is considered to be public space. Without seeing the OPs car park, it is pointless to speculate.

    So get off that broken gate. Do you now agree a resident's car park may or may not be public place?

    On the contrary it is YOU who thinks the broken gate is important
    But do the public have access to a residents car park? The broken gate may not change its status.
