    How about the PDT machine information though as that should contain the information about my wife's car? Should she be sending a SAR request (and therefore give her name away?)

    the VRM of the vehicle is personal data, therefore it can be asked for, including the PDT info (but not the other VRM details in that PDT info , so they redact them)

    if something is personal data , they should disclose it

    if its company data and nothing to do with you or your wife, they wont, because they are bound by the GDPR, but under CPR rules they may be asked for case information (under the PaP oct 2017)

    Anything that is not linked to the management and handling of you personal data (or the VRM of your vehicle) they have no obligation to provide - such as proof they've paid a debt collector. You have to very carefully frame your request in the context of personal data.

    If you think they've missed anything, send a reminder, clearly itemising anything you believe they've missed, and if a refusal, prevarication or non response is apparent (give them 7 days to provide), you make a complaint to the ICO. But don't expect the ICO to jump up and drop everything to help.

    If she is the registered keeper then surely they already know who she is?

    Anyway the keeper should send a SAR requiring the PDT machine data including her car/payment, or a close match to the VRN, as information relating to the VRN has been held by the ICO to be personal data that relates to a registered keeper.

    I am slightly confused as my wife is not the registered keeper of my vehicle; that's me. However, she input the registration number of her vehicle, not mine into the PDT machine hence the ticket.

    Therefore, that's not strictly my data but hers so I'm not sure if I can request it or whether she has to?

    OK, so tell the PPC that another car is owned by the family and you believe a driver of your car accidentally input the number of the other family car. This you are now adding a letter from the registered keeper of the second car to allow the data regarding the VRN list from the PDT machine that day, to be released under her DPA rights and in the interests of open dealing, a fundamental consumer right.

    Then your wife provides you with a letter saying she is the data subject of VRN xxx xxxx that she thinks a driver of the other car input in error, and she wants to see under her GDPR rights:

    - any images of her car entering/exiting that site on that day, or a nil return if the PPC confirm there are none, and

    - the VRN list for the hour between xxam till xxam from all PDT machines in that car park, showing her VRN or a close match to it (other VRNs on the list can be partially redacted, but the list must not be otherwise altered and must come from all PDT machines to discount all issues and clarify the data held about both family cars).

    She will need to provide her V5C as ID, like I assume you did.

    Keep going, this time as a team, and both only refer to the driver in the third person.

  • Hi Coupon and thanks again for this very useful advice. I didn't actually provide my V5C when I sent the original SAR but they didn't request it either.

    As I will send this via email, do you think my wife's letter should be included as an attached photograph of a hand written letter or will an additional typed letter suffice (to be included as part of the email and therefore without her written signature)?

    I'd provide a *signed* letter from her (but she doesn't have to use her real signature!).
