You seem to be getting the hang of things. :TPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ok, so I've had another reply. There has been no acknowledgement that they have previously lied about not having any record of my wife's registration number being input into the pay machine system.
Instead, in response to the scanned ticket I sent they state 'a full and accurate registration number of the vehicle which has been parked on site must be entered into the ticket machine; by failing to do that the ticket purchased was invalid and you became liable for the Charge Notice instead".
They add that that their previous letter "clearly explains our decision and addresses the issues you have raised in your initial appeal".
It obviously doesn't as my previous appeal requested a copy of registrations input into the system on that day and within the hour the PCN was incurred and they said they didn't have any record of it.
Is the next state to go to the 'Independent Appeals Service' or is there more to be done with this lot still?
Thanks as always for any input.0 -
Both appeals to Excel now rejected. The latest email I've received from them is in response to the appeal against the PCN for which we no longer have a ticket. It states that they will "continue to pursue this matter on the reasonable assumption that you were the driver of the vehicle on the date in question until information/evidence to the contrary is provided."
They also state that "any further appeals or challenges received by Excel Parking Services in relation to this Notice will not be acknowledged or responded to."
Looking over the Newbie's threads again, it appears that there's no point in appealing to the IAS so I suppose I should just sit tight and wait for the debt collection letters?
Doesn't look as though popcorn was required after all unfortunately.0 -

Anything that blows apart their assumption could stop them in their tracks, and will be useful evidence for court later anyway.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks Coupon. Is buying a ticket but inputting the incorrect information not a defence?
Unfortunately (at least in this instance), I've disabled tracking on Google maps but can see how useful it could have been here.
It's difficult for me to corroborate my whereabouts on those dates as I was working alone.0 -

Yes, you now ignore everything they or their debt collectors send you except a lbcca or Court correspondence.0 -

Good evening all
An update on the situations described previously:
I received a Letter Before Claim for both parking tickets and therefore followed the advice in the Newbies thread by sending a separate SAR for each ticket.
A response has been received from Excel but they have omitted to include information I requested in the SAR in the files they sent me. In particular, I requested A PDT machine record of payments made on the dates in question (stating that VRNs could be partially redacted). This has not been provided and nor has the evidence to show that Excel has paid a debt collector. I am not certain they have included all the emails I have sent them (as was also requested).
I had previously requested a PDT machine record before the SAR but Excel's reply was that they did not have this information. In the SAR, this request has been completely ignored.
As you might recall, they had claimed that the parking ticket had not been paid (with my wife's registration number on it) but we later found one of the tickets.
Do I take this back up with the data protection person at Excel?
Thanks in advance.0 -
The information on whether or not a debt collector has been paid is not personal data.
They can refuse to supply that information under a SAR.0
