Good morning,
I have had no response from Gladstones after sending them proof of employment so the case prep drags on. I have a couple of questions pleasE:
- Do I need to include a skeleton argument?
- Does the schedule of costs get included with the Witness Statement and sent in advance to court & gladstones?
- If I want to use my husband as lay representitive on the day, do I need to inform the court in advance (and how)?0 -
- you dont need to, but its useful to summarise for yourself
- send in costs one day before the hearing, or you could include now
- no, you just take a copy of the lay reps act.0 -

Is this the correct bit - "The Lay Representatives (Rights of Audience) Order 1999"
All other stuff I could find is for Scotland.
Also can you claim loss of day's leave etc for both lay rep and defendant? Or just the defendant?
Thanks0 -
Usually just the Defendant unless the Judge is on your side and you argue costs on the indemnity basis very well, listing how the C's conduct has been wholly unreasonable in terms of the court process, ambushing the D with late evidence, etc.The Lay Representatives (Rights of Audience) Order 1999PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

UKCPM have discontinued
Frustratingly a day after I finished putting together all the court documents, paying to get them nicely bound etc.
Is it worth pursuing them for costs?0 -
Probably not, unfortunately, IMHO.
Get your own back by appraising your MP about this case, and ask them to assure you of robust support of the Private Parking Bill going through its various stages this year.
And be happy that you beat the scammers - another one bites the dust!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Why are you trying to attract Bargepole's attention on a random thread, not your own?
No regulars have their inboxes open because we are immediately inundated with demands and requests for personal attention.
Now you've opened yours up to wanting PM communication, be very careful about anyone who now responds to you by PM. Not everyone is who they might seem to be on a public forum. PPCs have responded to previous pleas for private help. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi Bargepole, my wife received a PCN/NTK dated 04/09/2018 for parking at a residential car park. I have followed the NEWBIES appealing procedures and finally got the CLAIM FORM (dated 04/03/2019) from County Court Business Centre.
The claimant is VEHICLE CONTROL SERVICES LTD., claiming for £100 + £60 + £25 (court fee), totally £185. The driver of the vehicle has never been identified, and I have sent back the AOS on 16/03/2019 by signed for 1st class mail.
Please kindly advise that if I can use the defence for my wife's case by deleting some irrelevant paragraph/s.
Many thanks.0 -
