NEW Three Mobile Phone - No Returned Policy at Store purchased!!

@Three UK,I just purchased a 2 yrs contract phone from them 5 days ago. I hate the handset after only using it for 1 day. I went back to the shop to change it to an even higher contract but I was refused. I've been with them for 4 yrs. & I'm flipping disappointed and not happy at all! They said that because I bought it from the store, they have no return policy. If I had purchased it online then they have a 14 days return policy or even cancel it! OMG! If I had only known about it!! I have just checked their policy online here. For crying out loud! Why don't they have the same policy for the whole company! If you know of any legal advice you can give me, I would be most appreciated. Thank you.

You have no legal right to return an in store purchase if you change your mind unless the retailer's policy allows you to. Online is different as they have to follow the law which does allow you to return it.
Lots of retailers have different policies for in store and online purchases for that very reason.0 -
If it goes wrong in the first 30 days you can return for a full refund, I'm not suggesting you break it though!!0

Personally I think retailers should be more open to refunding / exchanging products bought in-store BUT there should be a penalty to compensate the retailer for now having a 2nd hand phone which will have to be sold as such.
If there was , for example , a £100 fee then it might make some people do more research when buying a phone.
Retailers shouldn't be hit in the pocket because someone " doesn't like it " and wants to try another.0 -
This is why they have all those demo handsets in store for you to try them out first.0

It amazes me that some people can't take responsibility for their own actions and mistakes. They seem to have been so spoilt by their parents that they think the world owes them a living and as such they need "spoon feeding " through life.
If you make a mistake live with it !

The phone has been opened, set up, and used. As such it can only be resold as used. How would you like it if they had agreed to exchange it and have given you someone else's cast off as 'new'?
If you think you will need to change it, then check the returns policy before buying: there is no statutory right to return something because you changed your mind.No free lunch, and no free laptop0 -
I think so too. At no point in the sale pitch when I was looking around in the store that the sales person said to me I can not return the phone if I don't like it. Especially, when it comes with a 2 years contract.0

It was not cheap. It costs £30 per month for a 2 year contract. I would not say that it is cheap at all!0
