TA10 form

Does the vendors solicitor take a copy before it is sent to buyers solicitor?
Our vendors form appears to have gone missing in transit to our solicitor and things seem to have come to a standstill without it. Thank you.

    Our vendors form appears to have gone missing in transit to our solicitor and things seem to have come to a standstill without it. Thank you.

    They should do, would be amazed if they didn't have a copy.
  • Thank you, our property Information form has also gone missing. Vendors solicitors were notified of this a week ago but it appears we are no further forwards. After waiting four weeks for our contract to turn up after it went missing, I am not prepared to wait another 4 weeks for these to turn up!

    Which is why I ask my solicitors if they have heard of email before I do business with 'em, which means I can more easily file everything; pre-sale enquiries, LA, environmental and water searches, report on title, etc digitally in the cloud for when I next need 'em.

    And I can turn round responses from buyers (including the ones I have to do as Freeholder on a little "Shared Freehold" Company where I act as Director) in a day or two. Beats waiting days or weeks for bits of paper to progress (or not) through two solicitors' hands via their clerks and the postal system then on to me by snail mail , so I can scribble my replies, walk to the copy shop and stick em in the pillar box...

    Amazingly, some solicitors still seem stuck in the 19th Century!

    But to answer your Q; of course they'll have kept a copy; it's part of the contractual relationship between buyer and seller!

    Always assuming they know their arris from their elbow; which seems a reasonable assumption?

    Could I not just go to the vendors solicitors and collect a copy of the missing forms? Considering noone can bloody talk to each other atm :mad:

    Yes; you could give it a go- although they may get precious and say that their client is paying them to talk to your solicitor, not to you. A polite way of saying "go forth and multiply"

    Chase your own solicitor too, but, maybe more importantly, tip off the selling Estate Agent. They won't get paid til you complete so the EA won't be happy at delay caused by simple administrative incompetence (letters never really get "lost in the post"!).

    It's normal for EAs to chivvy things along, either direct to both sides' solicitors, via their client, the seller, or both!

    Ultimately, all you can do is threaten to pull out if there is unacceptable delay, but you don't want that?

    (although with prices dropping round here, and no shortage of places to buy, I might threaten it in your shoes; I did pull out of a purchase of a Buy-to-Let flat once because the vendor, a housing developer who had taken it in part exchange for one of their new builds, had no-one who'd take responsibility for answering simple enquiries on this odd leftover flat... After several months I gave up and swallowed a few hundred quid in legal and search fees)

    The EA is fed up with me and sighs every time she answers the phone !!!128514; the last discussion about it she told me in no uncertain terms that the vendor and their solicitor have both confirmed it was completed and sent !!!128580; our solicitor said yesterday she was due to chase for it 'shortly' but then she also said that about emailing us about the mortgage report on Thursday too and this has yet to appear.
    Gonna speak to her again on Monday and ask the question about going to collect the forms because I'm well fed up, it is these forms and the local search that is preventing us from exchanging and I'd rather just be waiting on the search.

    Exasperating, isn't it? I almost get the feeling that some Estate Agents and Solicitors don't actually want clients as they get in the way of the smooth running of their business, lol!

    Clearly they see no correlation between satisfied punters and income from repeat business? We've used the same local EA on our last four sales (as we've not moved out of the area) and luckily, on at least two purchases (although you can't choose which agent you buy from).

    And we always put a solicitor to the test before we choose a conveyancer (local? accessible? picks up the phone? gives clear quote? confirms quote promptly by email? commits to send us stuff by email and not to commission any unwanted searches such as environmental, "plan-plus" or chancel check ones without instruction from us...)

    Both parties' PIFs, AND the contract, went missing in one transaction? Sounds to me like your solicitor is the problem, not Royal Mail...
