Then what did you receive on 17 July?

In your opening post you told us:
...I received a CCJ letter on 17 July 2018 to settle the claim.

I asked them, the date of issue was 17 July on the letter and I was told, they gave grace period, so the effective date of issue was 23 July.

Save4m, I mentioned in my first post on this thread that you need to be clear.

You told us in your opening post you received the letter on 17 July.
Now you tell us the Issue Date is 17 July.

The court said nothing about 'grace periods', did they?
    Again, be precise.

If your Claim Form was Issued on 17 July, then it is deemed served five days later - on 22 July.

That means you have until 5th August to do the Acknowledgement of Service. Good to see that you have now done the AoS.

You now have until 4pm on Monday 20th August 2018 to file your Defence.

    Yeah that's correct.
I was advised, that 22nd July was on Sunday so the date was triggered from 23 July.
    Sorry for the confusion.
Could you please all assist me, how to defence this claim. This is the first time, I have received this sort of claim.
Thanks again all of your support.

Hopefully what you have now understood is that this is a process driven by *precise* terms
You were not told the date of issue was the 23rd, you were told the date of *service* was the 23rd.
    Or rather, should have been.

You also did not have to talk to anyone - we asked you to look at the claim form, even gave you a diagram of it. You must follow these instructions, as the claim form is definitive.

You have to read POST TWO of the NEWBIES THREAD
    Now
    In detail
    More than once
    In bite size chunks.

No skimming. THis teaches you the proces. EVERYONE HERE had their first time, but you HAVE to take take positive steps yourself to understand the case.

So, once youve done this work, you should have some ideas for the defence. You MUST look up the Equality Act

We also need to see the Particulars of Claim - ON THE CLAIM FORM - to see *exacgtly* what they allege, plus copies of the other paperwork. Cover up details such as your name, address, VRM, etc - anything that personally identifies YOU or THIS CLAIM.

You do not have to have a Blue Badge to be disabled, read the Equality Act. It gives you many privileges which the able-bodied do not have.

In dealing with matters concerning the court, accuracy is a sine qua non, get it wrong and it could be costly in time and money to put matters right. Get your MP on board.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    http://parliamentlive.tv/event/index/2f0384f2-eba5-4fff-ab07-cf24b6a22918?in=12:49:41 recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. t. [/I]

    Thanks Everyone,
i will have a look all the points, which will be relevant to my case.
just a quick one, if i lose the claim, will i liable to pay any extra charges, because i was threatened by BW legal, if i defence this claim, then there may be extra charges on top of the claims of £243 ?

BW tell lies. Costs are limited in small claims. It will say on the form how much the claim is for.
