My Neighbour splattered paint all over my car and wont pay

I have parked in public parking bay on street and the building front and splattered white pain all over cars parked there and when i complained, i have been told you parked on public road and there is nothing to do with them, then they said i should't park where scaffolding been raised. how ever they accepted they caused the damage but after two month of demanding cost of valet and polish (£168) and few letters and emails when i threaten to take them to court they said the landlord decided to paint and there is nothing to do with them again. i am sure it wasn't the landlord because i saw them on scaffolding telling workers how and where to paint. is there any chance i take them to small claim court and what will happen if i loose in court?:mad::mad::mad:

    You can take them to court. If you're loose in court you will probably lose the case.

    You need to establish who the painters are and who their insurer is, then claim from them. If that goes nowhere, you can take it to a small claims court.

    Name the painters and tenant both as defendants

    His car was covered in paint, this is not just a normal quick buff up.

    That's cheap. I would normally pay around £350-400 when I used to get my cars detailed.

    Do you actually have a clue as to how much a full correction polish would be for something like that. Clearly not.

    You can use your legal cover on your insurance, or do a money claim online. I'd sue both the LL and the painters, not taking due care and negligent. If they told you to move, and you did'nt fair enough.

    Get two quotes, send a LBA and after 7 days go to MCOL.

    No, but to get someone to remove the paint and perform a correction polish plus a general valet is still going to be a reasonable cost.

    If the paint was water based then tbh I doubt a polish would've been required, a simple wash and clay would've sufficed.
