A few years ago a friend said I could open a Jacamo account in her name and address for me to use so now years down the line we have fallen out. She has reported it as fraud. I had all the stuff sent to my address as I was added as an extra on her account but all correspondence is and has been sent to her address I have mental health issues and finding it all very stressful. Can I go to prison for this? I have previous conviction for afray and breach of peace. I had a court fine and 12 month suspended sentence over 12 years ago. The catalogue (Jacamo) put up the credit limit a week ago and then I noticed it had been taken of and the account was in minus. I contacted her and she said Jacamo had told her to tell me to contact them so they can change the account into my name so I emailed them her and my details. I haven't admitted to fraud as she was beside me when I set the account up and said I can do it. They have emailed me to say they can not do what my friend had said to put the account in my name and was obviously lying as she is now ignoring my texts. And now I can not log into the account as it keeps saying "this account number is no longer active on this website" I have no idea why. I have today set up a standing order with my bank to Jacamo to keep paying. Please help I am so worried.

It's fraud but you're unlikely to go to jail.
Work with your friend to clear the account. It will remain in her name.0 -

Credit accounts cannot be swapped between people willy nilly, if someone takes out credit in a particular name, they are 100% responsible and nothing can take away that responsibility except insolvency or repayment of the debt in full.
To whom has she reported this as fraud ?
I would urge caution as continuing to pay a closed account, may mean your payments do not get directed to the right place.

The debt has been paid in installments on-time every month and like I said she was beside me when it was set up and she suggested to do it. Surely if they sell the debt they can only do that if it is in arrears? And will be in her name? I have admitted to using the account but with her permission surely the fact that she's been recieving all letters at her address where the account is registered shows she was a willing party to this. She just said she was reporting it as fraud and now when I try and login to make payment it says "this account number is no longer active on this website"

Who you were paying? The company directly or your friend?
If you have been paying Jacamo directly and they say the account number no loger exists do not keep paying across to them as your money will get lost in a void somewhere.
If you are concerned about paying keep the monthly amount aside in a separate account (don't touch it) so it is there if someone starts asking for it.
If you have been paying your friend the money to pay to the company it is possible she hasn't been paying and it has now been passed to a debt collector which will be why the account number no longer exists.
We won't go into why the account isn't in your own name or why you and your friend have fallen out but I would certainly be making sure you keep the amount you owe to one side for the time being£2 Savers Club for 2022 #120 -

I have been paying it online to the account itself. Surely if I set up a standing order with the account number as the reference it will be trackable? I'm worried that if I don't keep paying it they can use that against me?0 -

Open up a savings account and put the instalments in there so that your not tempted to spend it. That way, you can still pay the debt when the bill arrives. Then you could write to Jacamo and tell them what you are doing, to cover your backside.
It's probably a rubbish idea. Someone else will no doubt come along with something better.I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

Update I have spoke to Jacamo and they want me to admit I did it without consent and sending a form out to transfer the debt to my name but I am very dubious about this and will read it fully as I am not admitting to something I didn't do that could land me in serious trouble.0
