Highview & Tesco

My original question was:

Still a bit confused as to what to do, I too have received this from the same company and along with another letter from Tesco (same envelope) do I go into tesco and speak to management?

Or do I send them (tesco or highview?) a letter using the template in the sticky of this board.

Some help please.

Also the date of offence occurred on the 13th of July 2018 but the letter from highview & tesco is dated the 30th of July 2018. This is well past the 14 days (if this makes any difference). ''

I have gotten advice on from Keith & pogo fish. I'm just a little confused on how I would approach tesco management as that day (Silverburn shopping centre) as although I didnt buy anything from there in tesco but did so at the Debenham stores and other stores.

Just a bit nervous as to how I should approach this.

    use the blue text template to HIGHVIEW asap

    appeal as KEEPER, (no blabbing about who was driving)

    seems that HV failed the POFA2012 test, so it seems you have what we call a "golden ticket" if your appeal is worded correctly

    any complaint to the stores is better with proof of patronage, even if its from previous visits, like store cards and loyalty cards etc

    OK, I do have tesco credit cards so I will use that. Just go the letter today.

    Again just to confirm is this what I would post to them in writing:

    '' Re PCN number: (letter ref)

    I appeal and dispute your 'parking charge', as the keeper of the vehicle. I deny any liability.

    There will be no admissions as to who was driving and no assumptions can be drawn, nor was there an agreed contract. Your signage terms fail the test of 'large lettering' and prominence of the parking charge, as established in ParkingEye Ltd v Beavis, which is fully distinguished.

    Should you fail to cancel this PCN, I require with your rejection letter, all images taken of this vehicle & the signs at the location that day. Do not withhold any images or data later relied on for POPLA/court.

    Firms of your ilk were unanimously condemned in 2018 as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised too; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and say on camera 'we make it up sometimes' (BBC Watchdog).

    I will be making a formal complaint about your predatory conduct to your client landowner, as well as complaining in writing to my MP and ensuring that they are appraised of the debate where Parliament agreed unanimously: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''.

    Formal note:

    Service of any rejection letter/POPLA code and/or legal documents by email is expressly disallowed. All responses to me from this point on, must be made by post. Regardless of any MCOL online/email system, service of any court claim must only be made by first class post to the latest address provided by me.

    THE NAME AND POSTAL ADDRESS OF THE KEEPER (OR THE HIRER/LESSEE) GOES HERE. THE DRIVER IS NOT IDENTIFIED.

    Is this Silverburn in Glasgow?

    If so, POFA 2012 and keeper liability do not apply.

    As with your other post - Unless this involves a hire/company or otherwise owned vehicle, you ignore the PPC and complain strongly at management/senior management level.

    Do Tesco and Debenhams share the same car park? If so, Debenhams are the guys to complain to as a customer.

    The important thing is that you absolutely do not identify the driver of the vehicle to Highview - because if they don't know that, they are effectively scuppered for taking further action.
