Well done
Another one bites the dust !!2 -
who's car park was this?
I would put them in the firing line for any follow up action.
have you informed the car park owner of your win in court against their agents ?
what systems will the car park owner put in place to ensure that their agents will not repeat this (refusing to.cancel for another disabled driver /motorist/occupant)
unless something is done, then it will be business as usual, and the car park owner and PPC will await their next victimFrom the Plain Language Commission:

The above is true - the PPC breached their duty under the Equality Act and the landowner is liable for the actions of their agent. Well done - knew you could win this one!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I agree with the above and the judge
VCS breached the Equality Act as badly as the dwp do , it should have been dropped once evidence of the new blue badge was forthcoming, proving the Driver or Keeper was entitled to use the space
I would be issuing an LBC and then my own court claim due to the breach , naming both VCS and the landowner jointly on the claim form, with a minimum of £500 , or more
I have never known anyone to miraculously recover from disability the day the blue badge expires3 -
The more landowners are sued for the action of their agents (almost every winning motorist has an opportunity) the more quickly they will become increasingly nervous of dalliances with PPCs and their 'free' enforcement of parking conditions on car parks. Rarely is there ever a free lunch!
Nice win @OP.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
