    As my court date is nearing I am about to complete my Witness Statement.  As I was sent the court date last August I thought it best to clarify a few things.
    VCS were due to pay the £25 trial fee this week which I presume they will have done.  However on checking MCol although they list everything I have sent them in the claim status (including my DQ and defence) they only list the claimant's DQ as being received 2019.
    Also, should I have received a copy of VCs's DQ and defence by now?

    MCOL doesn't deal with your local allocated court
    Once it's been passed from mcol CCBC to your local court , the CCBC are no longer involved
    Your court papers tell you when the deadline for WS plus Exhibits should be exchanged and submitted to your local court

    VCS won't be filing a defence or DQ unless you counter claimed ?

    Many thanks for that Redx.  It's been dragging on for so long and for some reason I'd got in my head that all details from both sides would be entered on the MCOL site and no I haven't counter claimed.  The court date is 10 March so I will get cracking with the Witness Statement and exhibits which need to be in no later than 14 days before.

    I've just had a minor meltdown while doing the witness statement and exhibits read to deliver to the court on Monday, when the VCS witness statement landed through the letter-box today.
    On skimming through it I saw in bond it says "The claimant has not been provided with a copy of the defence and as such is unable to respond to the allegations within.  The claimant has contacted the court requesting a copy of the defence but has not received them.
    At first I panicked when I couldn't find when I sent the defence to VCS before I realised it was up to MCOL to do that.  On checking MCOL they received my defence June 2019.
    Is this likely to cause any problems?

    MCOL should also tell you when they sent VCS the DQ and a copy of the defence.

    On the MCOL claim details it doesn't mention that they sent my defence to VCS so I will try to contact them.  Would it cause problems if I sent VCS a copy of my defence? Even though it galls me to do anything to assist them I would hate to get to court and have the case delayed now it is only 2 weeks away.

    In their witness statement VCS sent me copies of their emails to court requesting a copy of my defence and yet again they came from Excel Parking Services! (my SAR request to VCS last year was replied to by Excel).

    MCOL does not state they sent the defence to the claimant, however I reckon VCS misfiled it. not the first time. 
    This isnt your issue but theirs. They should have applied to the court for a stay in the hearing date if they had a concern. 
    Dont send them a copy, its their job to sort. They coul dhave asked you months ago for a copy.

    Use that fact of the incorrect company issuing emails etc to the court if you have to

    There would be no reason for office depot to email someone on behalf of p c world , VCS and Excel trade as 2 separate companies and should remain so , again it's their error

    The court would not reply to your partner or boyfriend or uncle , just because they may live with you , same surname or not

    You are you , VCS are VCS , they should act professionally so their incompetent actions may be their downfall
