No.
The 10%+ 2mph (35mph in this case) is only a guideline and can be ignored.
This is for England but I'm sure Scotland will be the same.

Quite, but normal procedure is to enforce from 35 in a 30. I think I remember it being said in pepipoo that below the old ACPO enforcement levels it had been considered by the CPS as not being in the public interest to prosecute. I've seen it in actual CPS paperwork shown on pepioo.0 -

Anyway, as above, if action is taken against you (and the likely result is the offer of a Fixed Penalty of £100 and three points) you should check the terms and conditions of your policy. Some insurers will want you to tell them as soon as you receive the penalty, others only want to know at renewal.It's important that you do whatever they require. Three points for speeding will make very little difference to your premium with most insurers.0 -
I was driving the works van doing deliveries last week and was pulled over by the police and offered a fixed penalty notice for doing 32mph in a 30mph limit. I cant say for certain I was not doing 32 but in my opinion I was doing 30. I have spoke to a friend in the police and an grudgingly going to accept the penalty notice but my question is to do with notification of car insurance provider. My friend in the police told me whatever I do, don’t tell your car insurance as they will put up your premium but you are not duty bound to declare fixed penalty notices only convictions and as I am not going to court and being found guilty it is not a conviction. Although I trust my friend I still have a worry he’s mistaken does anyone know if this is the case or if I don’t notify I will invalidate my insurance? Thanks in advance for any reply’s
Ask you friend why there is a court conviction code against points added by fpn. I know there's no paper counterparts of the licence these days but if he's new into the police tell him it will show up on the pnc if he does a #DL.0 -
Wasn't there something in the papers re Police Scotland big wigs wanting a zero tolerance on all speeding offences i.e. motorists will get penalised for any mph over a limit. Wonder if the OP has been caught up in this fanciful nonsense?0
