Data Protection Breach - NHS

OK...
1: it was totally irrelevant, it had nothing to do with a data breach. It was filling to gain sympathy - they wanted to do the procedure but the local commissioners refused to pay for it. It happens, deal with it.
?
It wasn’t at all - it was to give the full story.
As I said from the start - I kept it concise. But since you’re questioning it, there is evidence to show that the GP has gone back and edited his notes from that day so they now state that he told from the start that the NHS would not fund this surgery. He didn’t tell me this at all, he edited his notes when he realised he !!!!ed up.0 -
Welcome to life - whilst our NHS continues to be abused by those expecting non-critical care it will ever be so. You found the answer to get the level of service you felt you deserved but you could throw a whole load of time and energy towards attempting to recover this from NHS and end up with nothing
It isn’t called the Critical Care Service, it’s the National Health Service - health covers many areas, including mental health. And the condition I had was causing me a great amount of distress.
Think outside the box instead of just trying to put people down.0 -

Ok so sue the GP (who isn't an NHS employee anyway...)0 -

No one's putting anyone down - I have needs that the NHS should cover but accept that in their eyes I'm not a priority and I'm lucky that I have an alternative to call on.
You too obviously felt it was important enough to seek an alternative and are now looking at reasons to be able to claim back your costs of going private. You're playing on DPA issues and forgery of reports whereas it could just have easily been a funding/priority decision made on the day of your treatment followed by a change of policy - you'd be in exactly the same position0 -
Any court case is dependent upon loss. You haven't actually lost anything, have you? It's unlikely that you'd win any case, and the legal fees would cost you far more than £500.
The NHS don't cover all conditions, and a vast majority of cosmetic procedures won't be funded, there just isn't the money to do it for everyone. Your GP could have appealed to the PCT and you could have put your case forward, but it sounds like you weren't able to wait so you went ahead anyway. Sorry to sound harsh and I hope that it worked out for you.0 -
The NHS didn't think spending 4,000 on you was a good investment [read how organs are allocated if you're in any doubt that cases are discussed on a need and outcome basis].
You thought it was.
Now you are trying to recover this money because you believe that the NHS owes you.
It doesn't.
£500 is a good offer for a data breach.Non me fac calcitrare tuum culi0 -

Ok - I don't think everybody is quite understanding. I was promised surgery for over 2 years, I had prepared myself for the condition to be rectified that had affected me for about 15 years, and only 3 days before this was to take place it was taken away from me - so I had to go private to have it done. I couldn't really afford it, hence why I got a loan and didn't just take £4,000 out of my bank, and I'm still struggling by each month due to the repayments I'm having to make. However, I couldn't bare to be so close and it not happen. Both the GP's surgery & the surgeon believe I am owed the money by the NHS - it is just a case of getting the Trust to pay out. SO thanks to those who tell me I am wrong to expect the money to be refunded - but I am going to take the medical professionals word and continue to fight for what I feel I am owed.
Some people have got hung up on the back story, which was simply there to provide all the details as to why I was making a complaint and how we got to this point etc., however, the real question was: What is my data worth? I had no idea whether to expect £50 or £500,000 - so wanted to know whether the £500 offer was reasonable. It turns out that it is - so thanks for letting me know.0 -

That!!!8217;s funny both the gp and the surgeon think someone else owes you money...
Have you considered at all that medical professionals are not LEGAL professionals?...
Best of luck with this, I suspect you!!!8217;re just throwing good money after bad.0
