This previous POPLA decision goes to show the weakness of some POPLA assessors in what is really very elementary arithmetic.From the evidence provided by the appellant, I can see that the date of the contravention was 6 December 2017, as such, the relevant period starts on 7 December, and it must be received by 21 December. The appellant himself has confirmed that he received the document on 21 December. Therefore, I am satisfied that the notice was received within the given timescale.
Unfortunately this particular POPLA assessor did not use their Fisher Price counting beads to work out that the period 7th - 21st December covered 15 days not 14.0 -
GD and I nailed it!

All CEL ones are golden tickets (non-POFA wording), and we've known that for years.

Believe it or not, CEL have recently "upped their game" (albeit from a very low base) and have a new style of PCN on which they actually make an attempt to use the wording from POFA.0

I think you are incorrect. But please advise where I have gone wrong in my table.
Apologies. I was incorrect with the date but correct with the calculation of Day 0, Day 1... Day 14.. I obviously should have counted on my fingers:)
To summarise:-
The day of the parking "crime" is Day 0, Day 1 is 6th & it must be delivered by Day 14 which in this case is 19/7/2018.
The NTK is deemed delivered two working days after the date it was sent & that cannot be any earlier than the date of issue (18/7/2018) so the delivery date is 20/7/2018 which misses the deadline by a day.0 -

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently
