    No-one pays a private parking charge, and if you are at LBC or court stage they are asking for MORE than you need to pay even if you lose at a local hearing!

    Madness. You must be looking at around two hundred quid. NO-ONE would pay that!

    Everyone has a case. We win 99% of the time.

    Why do you think you are one of the 1% like phoenixfreespirit, a very rare case that was lost mainly because the OP struggled to explain why the NTK and signage meant the POFA did not apply, and that there was no contract agreed.

  • Thank you so much for responding. I am going to read the FAQ's on how to use the forum and re-read the newbie's posts. If I need to start a new thread for some help I will.

    Can I just say that after reading through this forum for the last few days, you people are so kind and helpful to people like me who get really distressed by these threatening letters. It must take up so much of your time so a great big thank you to all who take the time and trouble to answer these posts.

    I'll keep my story short.

    We sold a vehicle 2 years ago. The new keeper got a parking ticket in a time restricted private car park 3 days later.

    The letter came through post a few days later, i remember i phoned them and asked for guidance. However in the end o decided just to fill in the buyer details into that letter provided and post it back. Never heard back from them since then.

    Two weeks ago we got a letter from bwlegal "we've been instructed by xx'x to.... blabla". I've ignored the first one but now i got a letter of claim along with a couple of forms asking financial details, and some 30 days time to respond threatening a Claim in County Court.

    I've emailed them briefly that i informed the parking company years ago of a keepers change and they shouldn't chase us for this pcn. And i advised them to follow up with the parking company.
    In an email reply they ask full name, line of address and postcode saying "Thank you for your recent email, the contents of which have been noted on file.

    Should you wish to discuss this matter via email, please confirm the following:"

    Should i confirm them those? I don't feel likely. In my email i gave them reference numbers.

    I'm confident we can prove in court we were not the drivers neither keepers of that vehicle at that time.. but i don't want to get there and i rather sleep relaxed in the mean time.

Please start a new thread of your own (large rectangular red button near the top of the page, one back from this thread - hit your 'Back' button to land there), but only do so after reading the newbies sticky, which should take a few hours to digest fully - get yourself a brew and a notepad and pencil.
