I am afraid that is not a say what you like on Facebook get out of jail free card and as far as I can see has little relevance. Good luck with that one. Not only is there no relevance in that case as a defence for threats and intimidation against colleagues, but it is always good, when in a hole, to continue digging. That way the employer will realise that you are likely to be litigious, and sack you now whilst they have a solid case, instead of considering giving you a second second chance based on the grovelling apology you unwisely aren't making. 0 -

Ah man, that post is disgusting. That is on par with what a dangerous convict would think/say. An absolute disconnect with your own self-interest (remaining in your job) and empathy (recognising that people are different, have their own motivations, and are ultimately imperfect little vessels themselves).
I don't doubt that you/brother have some legitimate grievances, but in a civilised society it needs to be done in the correct way. And you need to look after yourselves first and foremost. Number 1, don't get into a position where others can "grass" on you (and even if they do, make it so that the EMPLOYER knows you work hard and so that they back you up against people who are probably jealous). Number 2, getting involved by inflicting the same !!!! on them is just pointless in the grand scheme of things. You are looking out for yourself and brother. Sod anyone else, and what they think. Clean your buses, be polite to everyone and pick up your paycheque. Sod everything else. Then maybe go and look at further education and the likes. Improve yourself, and aim for better.
Regarding the Whitham V Club 24 case, I found a link which summarises it (I think it is the same case):

According to that page, the comments made by Ms Whitham were pretty "mild" compared to yours! She allegedly put "I think I work in a nursery and I do not mean working with plant" which is pretty generalised in that who is the baby? But in your case, it is aimed at a specific employee and pretty heavy. I don't think you are on par with this case tbh, and you'd probably be better with a grovelling apology rather than quoting this case (you might be relying on their ignorance if you quote it).0 -

I'm fairly sure Ms Whitham also didn't repost her comments on a very public website, including just enough details for anyone in the workplace to identify the individual and report their post to the employer - say, for example, the two people who have already been threatened???
But I would have to disagree that the comments are on a par with those of a dangerous criminal. A really dangerous criminal would more likely be polite, courteous and strike when you are least expecting it, and look pure as the driven snow after having nailed you. The kind of language here suggests a rather low level thug with a high recidivism rate as they are too daft to not get caught every time!0 -

Your problem is that Threats and promises are not mutually exclusive! Just because it's a promise does not exclude it being a threat. E.g
"I promise to scratch your car if you do not vote for me on the board meeting"
