Hi all
Hope some one can help.
I had a email today off lantern which I worked out used to be mmf. Sayying that they need to speak to me about my ref. Please register on the site to make a payment plan so I registered to see what this was. No address given just my email against ref number. A debt for 6300 off British credit trust. I can't recall numbers but I remember I had ccj on my first ever car when I was 18. The ccj went on few years later. While I had that ccj I moved In with my gf rented.(both on rent papers) for 3 years. Moved again rented a house for 5 years together. Then bought a house last year.
The ccj was there a few years ago but was not on my credit report last year or I wouldn't have got the mortgage. It was off for few years before this to, I just cant recall when it left my report. But till today I have not hered nothing about it and i still don't know this is about 100 percent but it must be.
There's no info on the site about where the 6300 is from etc. So far i have sent a message sayying this has nothing to do with me as I have no debt and you must have the wrong person.
Am I going to have to start to pay this? I have seen they have to request to take action from a judge after I sent a template letter. Would the judge say ok ?
Where's the temple letter ready please.
Thank you

That's a good start. See if they come back with a court reference.
It's possible they do not know about the ccj and could be persuaded to drop this.
Even if they do come back with info on the ccj you can point out that it can now only be enforced by specific order of the court

You could also throw in Limitation Act s24 which many creditors believe limits enforcement to 6 years

Ok after reading a few is it better to send the limitation act letter first before asking them to have a go through court.
If they ask through the court and say judge says yeah they can go for it will I get another ccj then.0 -

It does not work like that Kieran,
You are only asking for details of the original debt, for anything else, the case must formally be brought back to court, there would be a process to go through, you don’t just say to to the judge, oh that Kieran lad, well av him now he’s surfaced.

I couldn't been hard to find. I had a car on finance for last 5 years. I'm.on the eletrol roll etc. Until that email I thought it just gone from age.0

Basically wait to see what they say, once you have heard, come back here and let us know.0

That's effectively what a prove-it letter is, so your first action was correct. Their response will show you what they know (and what they don't know).
This is a one-step-at a-time process. Don't jump ahead, particularly if you are not familiar with the legal framework for chasing debts. You could shoot yourself in the foot.
You cannot have a second ccj for the same debt.

Typical reaction from MMF sorry, they are Lantern now, i keep forgetting.
I`ve dealt with them before, so i know what a bunch of dim witted individuals and neanderthals we are talking about, real old skool scam artists this lot, they were hauled over the coals by the regulator for good reason previously for breaking just about every rule in the book.
They like to ignore correspondence, it makes you more inclined to ring them you see, which is what they are after, so they can bully you into paying over the phone, don`t fall for it, write back enclosing a copy of your original letter and ask them to comply with your original request for information.
Give them an imaginary time scale in which to respond.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I have recived a letter today off your self.
First of all sayying there has been no contact when I sent a email off your site to you on the 16th of july.
To which I have had no response to.
I have no idea what this debt you claiming I need to pay is. As I am aware I have no outstanding debt and never have. I would like evidence of this debt with dates of when this debt occurred.
Thank you.
Is this ok.to send back ?
I can't.provide evidence I emailed them as it was on their site. One of them fill in boxes.0
