Learner stranded in box junction. Who pays?

Driving back on the dual carriageway I stopped at a box junction with a little learner car perfectly stranded in congested traffic on the final third of the hatching, ahead and to the lane left of me.
She was there quite a long while, and even when the traffic on my lane moved off, she remained stuck. I suppose her instructor told her not to change lanes.
I passed them and could see the instructor getting quite animated with a worried young woman in the driver's seat.
So if they get a fixed penalty notice, who pays? The instructor who should have told her not to proceed, or the learner driver?

The instructor is equally responsible imo. Whether that's technically the case though I doubt it0

It's always the driver regardless. Plenty of occasions of L drivers being done for speeding in a dual controlled car...0

My wife was a driving instructor and it will be the driver that gets any points and is liable for the fine.
Depending on the circumstances some instructors will pay the financial penalty.
I think there would be some interesting conversations in some cases :rotfl:

You have to pass the theory test before you can take the practical, but you don't have to wait until you've done the theory to start learning to drive practically. That's how it should be too IMHO.0 -
Being a learner, when seeing their exit is clear, and progressing slowly through the box its entirely possible some one cut over from the right lane and used the exit space.0
