Evans Cycles Plymouth - Britannia Parking

As registered keeper of the vehicle, I received a Parking Charge from Britannia Parking. The vehicle was used on a visit to Evans Cycles Plymouth where it was parked downstairs in the 'free customer' parking spaces. It was not made clear to register the car reg at the till nor did the staff highlight this. Documentation is available and an email from store manager proving it was a genuine visit to the store. Britannia sent through the fine, so I followed their instruction to appeal, however on doing so the website informed me I could "not appeal at that time", (this was within the 28 days of notices) - I have screen shots to prove. I tried several times over the next week, but site would not let me appeal. The appeal deadline passed. I wanted to appeal to POPLA but according to the Britannia notice it would not be accepted as I haven't appealed to Britannia Parking in the first instance. This case has now been passed to 'Debt Recovery Plus' DRP who are now demanding £160 for "failed to validate stay or make a valid payment". Please help

IGNORE drp
complain to the BPA by email about being unable to appeal to BRIT and provide copies of the paperwork and any proof like screenshots etc
also complain to the landowner or MA or the retailer (or all of them) and INSIST that they get the pcn cancelled, include copies of your authorisation etc, also informing them of their failure to make it clear at the till and on the door etc
it is bad for business to target genuine customers and so any parking regime is in place to deter non-customers. this type of sc@m is killing these businesses as people who have been sc@mmed do not return and they lose custom0 -
seems to be a common problem with brittania , look at this thread , and others and follow the actions they did https://forums.moneysavingexpert.com/discussion/5845315/britannia-parking-online-appeal-proceedure-refused-access-within-28-days-period&highlight=britannia+parking0

Everyone is politely asked to read up on this in the Newbies FAQ thread near the top of the forum before starting a new thread
Go there now to learn about the game you are now caught up in and how to deal with this
Throughout here you are advised never to reveal who was driving.
You need to edit your post to remove details of who was driving
#4 in the FAQ covers debt collectors and how to deal with them by ignoring them.
Get on to the retailer and complain about this. Ask them to get this cancelled
In the unlikely event that you get a lbcca or Court correspondence over this then come back for advice on how to deal with this at the time0 -
Thank you, (edit complete).0

RESULT!!!
I complained strongly to the store manager who said he would email his contact at Britannia. a day or so later he replied with the following...
"On this occasion Britannia have recovered from the debt services and given a further 14 days on the previous payment of £100. This has however exhausted my further outcome over this PCN with Britannia.
I have spoken to my customer relations team this afternoon who have sent through a link to POPLA, see below, who can give advice and assist with appealing a PCN."
Evans customer service team obviously do not understand the scam which Britannia are running. I was also miffed the store manager had thrown his cards in so easily and happy that a genuine customer was going through this, I asked for the contact details of his Regional Manager, which he sent to me.
I then emailed the regional manager and complained 'very strongly'. I also emailed the AOS <aos@britishparking.co.uk> - British Parking Association with evidence, screen shots, of the Britannia website not allowing me to appeal.
The BPA opened an investigation and later replied saying I had 14 days to appeal with Britannia.
In the meantime the Regional Manager for Evans contacted me to inform me she was going to pay the PCN on my behalf...which she did!!!
in between emails a 'second' different debt recovery company sent me a letter demanding a completely different fine of £130! - what the hell? - I've not responded.
Britannia have now emailed me to confirm the fine has been paid and PCN closed.
I am extremely relieved this is now over as this has been on-going since April 2018.
I must say how this website has been such a massive help and support system, with spot on advise.
Thank you everybody!

Good news for you.
If Evans continue to do this the BRIT scammers will think
they are easy targets ..... not your problem though.
Evans don't understand about scammers who could
bust them
The BPA by the way are utter rubbish0 -
so the sc@mmers are sc@mming their own retailers as well as the public
I suggest you write back to that regional manager and tell him why his form will lose footfall and business , as well as all their profits , no wonder uk retailers are going into decline0 -
If the debt collector letters continue, another complaint to the BPA for them to kick the asss of Britannia, who are fully responsible for the actions of their agents (the debt collectors). Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Totally agree and as you say, its not my problem now. I see this as a little of what goes around comes around!0

Evans said Britannia are not employed by them, but by their landlord. But not my problem anymore!
Hopefully Evans will wake up to this before they lose too many customers.
Thanks for the advise.0
