    OP - do you have legal cover on home/other insurance? Some home insurers offer a legal helpline even if you don't have cover. At least you'll be able to discuss the facts with someone without vested interests.

    You are correct to say the op still can go to court

    But up to now the OP had nothing to lose. Escalation to the FOS is all at no cost to the policyholder

    Taking legal action is costly and you must win to be able to get your costs back off the losing defendant

    The only case the OP could try to win is that the policy conditions allowing the insurer to deal with claims as they think fit is unfair!

    No chance there. No insurer could operate without that condition!!

    (Home insurance legal cover doesn't cover anything to do with motor disputes)

    Yea ive alreay changed insurance. Never going with directline again they provide no help

    I was with direct line for years.... seemed okay.

    That said, insurance companies are all pretty crappy. I'm surprised how good 1st Central have been with me as their reviews are horrendous. That said, I was with esure for a bit and found they were poor, despite decent reviews.

    Any insurance company who considers you to be at fault (and I agree with the many other posters who think this is the case) will have done exactly the same and admitted liability for you.


    They are not going to spend time and money contesting a case where they think that they are liable.

    They accept i was stationary when the collision happened. Initially the claim was 50/50 but i was never told this. They say the accident is my fault because i was ‘in the middle of carrying out a manoeuvre’ and also say i shouldnt even have been in the yellow box.
    They continuously gave me wrong information throughout, never gave me any updates till i rang them, and over all made the whole thing alot more stressful than it should have been.
    I also know other people who have had similar issues with directline.
    Its not only about them having accepted liability after telling me on multiple occasions they wont, it was everything that happened after my accident.

    To be honest in my view the fact that he hit you when only half in the right turn lane puts you at fault due to bad positioning. A 50/50 would still affect your insurance cos it still shows as at fault.
