    Yes more or less, so i was not in the way of third party driver going straight. But rather slightly turned into the turning right lane of oncoming traffic. This too only because the direction third party driver came from has a bend slightly back and he came speeding around this bend.

    Yeah. I don't think you should have been there. You should have waited on your own carriageway, ever so slightly turned, indicator on, waiting for a clear gap - not crossing over the oncoming carriageway as far as you can, then waiting.

    I wasnt turned as far as the picture, i was also turning to go into the inside lane.

    Looks 50/50 to me and you would have a hard time winning a case to say you weren't at fault,


    directline were incorrect to tell you that you weren't at fault intially, however I'm not sure what mileage you can get out of that.

    Once my renewal came up and i went to cancel it i was told the claim was initially 50/50. That was the first time that was mentioned to me and i was not given a reason why it was changed.
    Any ideas i can convince ombudsman that direct line are wrong to put the whole blame on me?
    They arent using blacbkox data or witnesses but ombudsman say directline followed proceadure so its fine.

    Feudal Britain needs land reform. 70% of the land is "owned" by 1 % of the population and at least 50% is unregistered (inherited by landed gentry). Thats why your slave box costs so much..

    Its all academic now and we must try not to get emotionally involved. Cars were bashed, luckily no one was hurt.

    One has to wonder at why the other driver simply drove into you? Were you in forward motion and about to make the turn and then he suddenly appeared?

    On big junctions like this i would tend to avoid entering the box junction and keep to the relative safety of keeping the lights/traffic island in alignment with my drivers side window.

    Were you parallel or had you turned slightly right ?

    Either way without video and/or photographic evidence i think the insurance co's will call it 50/50 at best

    total guess but I suspect the third party was in the right turning lane by mistake and was wanting to move over to the straight lane, Was paying attention to his mirrors watching for a opening in the left lane and neglected to see or expected the OP to be in the lane ahead of him.
