you have been told what to do several times already

you serve notice and you go in. If you fear a breach of the peace in so doing you notify the police in advance and you be prepared to ring them again if things turn physical when you enter.

As it seems you can't cope with this on your own why have you not joined a landlord association as previously advised and got their professional help. You are throwing away money anyway so spend some on getting someone else to sort your problem out for you.

The OP's dad should join a landlord association and start getting legal advice.

Hi! !Please can someone give us some advice.! My Dad let a small flat in March, the day before the person moved in but after he had paid his deposit, we were told that he has aspergers.! We were reassured by him and his social worker that he could afford the rent and that he had support.! We have an assured shorthold tenancy agreement.! Since then everything has gone south.! He has vandalised the flat including smashing the coin meter and stealing the money, smashed a window onto a neighbouring property, wont allow us access to the property and is 2 months in arrears.! Firstly a question about the electric meter, does he have the right to refuse us access to empty the coin meter?! Water is coming through the ceiling into the property below but he wont let us in to sort it, can we (a) turn off the water or (b) enter without permission as we are concerned about the water shorting the electrics and causing a fire and obviously the tenant below is none too happy either?! He/his friends have also kicked the door in and smashed the lock for a second time, can we enter without his permission to check the state of the flat?!!

Any advice would be very much appreciated, this is a nightmare.

    Many thanks

Is there still water leaking into the flat below?

Have you issued a S8 notice as G_M suggested in post 13? Or, which of the steps detailed in that post have you taken?

I would inform the social workers that you don`t believe they are doing their job properly, and that they should have informed you about the situation much earlier than the day before (that was deliberate on their part to get him housed IMO) and that you are going to make an official complaint against them, that may motivate them to get him to contact them. Then you need to serve notice ASAP, there will be plenty of advice here on what that could involve, and you need to check tenants out better in future :) This guy sounds like he needs more support than he is getting.

What ground(s) was used for the Section 8?

How did the tenant manage to prevent entry to the property?

Tenant has been living in a flat without water..? I should think social services would want to know that.

If you can start the court process based on the S8 then that seems like the logical next step. I assume you don't want them to stay even if you manage to get this fixed!
