PCN from PCS on behalf of CUP Enforcement
JASOG
I recently received a PCN through the post from PCS on behalf of their client CUP Enforcement. No notice to driver on windscreen. I intend to formally appeal using the appeal template. The reason for the new thread is this. The driver at the time is an independent courier driver, and the PCN stems from a delivery that was being made to the same address highlighted on the PCN. When making the appeal, I believe that there is an option to upload any evidence to support the appeal. Was wondering if a copy of the drivers official delivery sheet would be worthwhile including. And maybe add that I believe it highly unlikely that any court would find in their favour in the circumstances. Would appreciate some guidance on whether to include this evidence of delivery or not. Thanks in advance.

Just send the template appeal as is.
Throughout here you are advised never to reveal who was driving.
You need to edit your posts which do give details of who was driving
The ppcs monitor this forum and can use posts against you0 -
Couriers, taxi drivers, ambulances, all are fair game for these scammers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -
I recently received a PCN through the post from PCS on behalf of their client CUP Enforcement. No notice to driver on windscreen. First I knew anything about this. As I mentioned on another thread, I intend to formally appeal using the appeal template. The reason for the new thread is this. The driver is an independent courier driver, and the PCN stems from a delivery that was being made to the same address highlighted on the PCN. When making the appeal, I believe that there is an option to upload any evidence to support the appeal. Was wondering if a copy of the official delivery sheet would be worthwhile including. Of course I would redact any mention of driver identity. And maybe add that I believe it highly unlikely that any court would find in their favour in the circumstances. Would appreciate some guidance on whether to include this evidence of delivery or not. Thanks in advance.
You cannot get a PCN on behalf of another company ?
PCS is a debt collector .... Parking Collection Services
http://www.parkingcsl.co.uk/
As this is a debt collector you can ignore it because
they are powerless muppets
Be interesting to see how they word their letter.
CUP Enforcement is run by an ex clamper and if they want
to go further they will contact you, then you come back here
for help.
DO NOT go talking to powerless debt collectors, they can
do nothing0 -
Thanks for the advice. Have now sent appeal template. Will wait to hear their response. Will repost here on this issue if need be when they make contact. Thanks again.0

They will, and they will reject the appeal and then you ignore everything except a court claim.
Yes but only if they get Gladstones to send a LBC or a claim.CUP Enforcement is run by an ex clamper and if they want
to go further they will contact you, then you come back here
for help.
Please no updates AT ALL about debt collector letters. Spare us, please read the forum NEWBIES thread instead.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So here is a summery of the situation as it stands to date having received a number of letters regarding this alleged parking offence.
#1. Initial PCN from PCS dated 21/06/2018
I made appeal on their website using template appeal. Requesting that they shared any photographic evidence of the alleged offence. None was offered.
#2. A reminder of the alleged offence from DRP.
#3. A letter from DRP claiming that POPLA had reviewed the evidence that I submitted and has already ruled in their favour. I HAVE NEVER EVEN BEEN GIVEN A POPLA NUMBER BY THEM TO EVEN MAKE AN APPEAL !!!
#4. Final Chance to Pay letter from DRP.
#5. Letter from Zenith Collections, stating they are now handling this issue, and offered a £24 discount on the sum payment.
#6. Letter from Zenith acknowledging payment not received, and would revert back to full payment due in 14 days.
And now today I received,
#7. Letter from Gladstones Solicitors, threatening the possibility of Court proceedings should the fine remain unpaid.
So what should my response be to this now. Any advice would be greatly appreciated. Thanks in advance.0 -
Is your latest letter from GS a Letter of Claim?
Or is it just another debt collectors letter?
"threatening the possibility of Court proceedings" doesn't sound to serious to me.
How long does it give you to respond? Thirty days? or less?
Does it include reply forms?0 -
If they use words such as "may" and "will advise our client to" it is not a letter before action. You never know how far you can go until you go too far.0

Now you come to mention it, I don't think they are actually saying anything more than the debt collectors letters really. Just that it has a solicitors letterhead instead of the debt collectors one. They seem to be just outlining the options open to their "client", ultimately Civil Court proceedings, and that I should make arrangements with DRP to make payment in full within 14 days. There are no reply forms. They also suggested places where I could take advice on this situation. But cunningly omitted to mention the MSE Forum !!!0

...I should make arrangements with DRP to make payment...
That in itself is enough to tell us that this is a debt collectors letter - DRP just happen to be using Gladstones headed paper.
Ignore it.0
