seller takes the biscuit

I won an item on ebay that never arrived. I allowed 14 days due to the postal strikes, and dropped the seller an email asking if they had posted it as I hadn't recieved it.

I got a very snotty reply back saying they had posted it, and she was angry me for taking 14 days to tell them it hadn't arrived :confused:

Mailed back and said I still hadn't got it, and could I have a refund. Seller said no as she posted it, and it wasn't her problem that I hadn't got it. I replied and politely reminded her that she was responsible for getting the item to me, and politely explained to her that she should refund me and make a claim with Royal Mail for the lost item.

The latest email I got back said:
Hi,
I really have sent the parcel and I always want to keep my 100% feedback. I can't give you refund as I have really sent the parcel to your address. I haven't got it returned to my address so I don't know why you haven't got it. Sorry I cannot refund you as I posted it and it's not my problem that it hasn't got to you. I cannot refund you as I will loose out. I cannot claim from Royal Mail as I have no proof. I just put stamps on and put it in the box. Therefore I cannot refund you as I can't claim the money back. I hope you understand and will still leave me positive feedback as I want to keep my 100% feedback.

So I'm supposed to pay for something, not get it and still leave positive feedback? :eek:

I've put in a claim with PayPal and reported her to ebay.

I'm intending leaving neg feedback, but I'm expecting a neg in return from her. Is there anything I can do to prevent her doing that, or will I just have to take it on the chin?

    Just leave a follow-up if necessary - no-one likes a seller who refused to accept responsibility for posted items.

    Make sure your neg doesn't break any rules, wouldn't want it to get removed :D

    Just quote her in the neg 'Sorry I cannot refund you as I posted it and it's not my problem' that should show any future buyers what they would be dealing with.

    i hope you get your money back through paypal - might make the seller realise that it is her problem!

    A newbie? I think I might write once more suggesting that if they wish to keep their feedback they need to refund immediately and point out the error of their ways.

    Reply and say actually it IS up to her to refund you as she should have at least got proof of postage (depending on value of item) and that she wouldn't have lost out had she done so.

    Neg her and follow up on yours!

    She's been registered just over a year, and has 76 positives and 2 neutrals.

    One neutral was for overcharging on postage, and the other neutral was for something that was lost in the post. Seller left a neutral back complaining that she was left a neutral!

    I appreciate things do get lost in the post, but I would have left her positive feedback if she had sorted this out rather than just saying "not my problem".

    It was the last email asking for positive feedback that made both cross and gobsmacked at the same time!

    Well done OP - I love it when sellers who wheel out the "I'm not responsible for items lost in the post" have paypal disputes opened on them!

    Soon proves to them that they "are" indeed responsible.

    I guess paypalsucks will have a new whinger on board soon as well.

    "I said that I'm not responsible for items lost in the post, and paypal being theiving conmen said that i was and then they gave my money back to the buyer and i have no money and no item and woe is me and it's just not fair and paypal should be illegal and i dont like them" etc etc etc etc...

    btw - neg them hard! Enjoy it, and wear any neg returned to you like a medal awarded for victory in battle against a muppet!

    I really can't believe some of the stories about buyers/sellers I read on this board.

    But I agree, this seller is taking the biscuit. And I do love to see paypal disputes brought against sellers who think a buyer not receiving an item is 'not their problem'.

    Hope you get it sorted, and I hope you enjoy negging them.
