INDIGO again

INDIGO have written again rejecting all points. They say POPLA suspended but not by whom or why. They say that ADR resolution is now at Magistrates Courts. Sent another letter to query some points and reiterate view they are being disproportionate, unreasonable and unfair. Also querying how Magistrates Court can be ADR within Act.0

good , keep playing ping pong and dragging it out past the 6 months deadline then0

I would stop replying after that - you've spent enough on stamps, and despite the letters that will follow from QDR and ZZPS, the scam ends after 6 months.INDIGO have written again rejecting all my points. Indigo cannot take this to Mags court, as you know (my post told you their contract does not allow it), so it is a lie, or at best misleading.
No need to tell us about the next ZZPS and QDR 'solicitors' letters. All hogwash!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Needed to come back, not least as this place is good for moral support but as anticipated, have now received a letter, not from QDR or ZZPS but from DPS 'Debt Recovery Prosecution Service' . They are now asking for the non-discounted rate (£100) or £165
What's important here is that they say 'according to information received from DVLA you were registered owner of vehicle' . Secondly, in tiny print at bottom, it says London & Southeastern Railways Trading as Debt Recovery & Prosecution Service. So it is now the Train Operating Company (TOC). This has the driver rattled.0 -
Registered owner? owner and keeper can be two different things altogether.
Plus no such thing as registered owner. Could be worth a letter ping pong asking them to clarifyFrom the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
If they really say registered owner you can have weeks of fun asking them how they got that information as the DVLA state there is no register of owners.0
-
To be precise it refers to 'registered owner/ keeper of the vehicle' and at the top it says 'liability for this parking penalty lies with the vehicle's owner'.
As they appear to have info from DVLA (could they possibly lie about this?) and they also appear to be the TOC trading as a debt recovery company, driver is more concerned that the TOC is now actually doing something?0 -

stop being rattled ,
perhaps handing all your info to the rain co was a bad idea ,
never mind , 4 mths down the line now and presumably Debt recovery and prosecution have given you 28 days to pay? (ok 14) , ping pong should be practiced via second lass post0 -
No of course not, have you searched the forum for the unusual word in that name 'PROSECUTION' (not the other words, far too common on this forum!).
Everyone gets that letter from DRPS, with Indigo PCNs in that area. If you didn't know this, you have not read enough similar threads and were staying too isolated on this thread. Do the search for that keyword. Threads going back to at least 2017 show you that your six months is progressing EXACTLY as expected.
The letter is normal.
Why would they? Parking firms and landowners buy DVLA data for £2.50, it's part of the entire national disgrace of the parking industry.they appear to have info from DVLA (could they possibly lie about this?)PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The subject of this thread has had letters from DPS in the fifth month with increasing factual mistakes. The driver replies on points and continues to ask why no Independent Dispute Resolution. Happy to continue - but in the thread- a link from Newbies- by the excellent woman poster who summed up rail-park PNs, there is a comment further down by someone:
IGNORE anything else except a formal LBC, and/or an MCOL , within 6 years.
Six years? Will it hang over the pensioner driver for six years? I'm assuming MCOL is Magistrates Court Official Letter but unclear about LBC.0
