BUT no matter how it gets to court, the seller could fight it, and even if you win, that doesnt mean anything other than you have the right - at your expense - to pursue him for the money.
Well who would roll over so easily?

My guess is they will fight it as long as they can, in which case, if he doesn't want to issue the refund then who's physically going to make this guy?

The thing is that he can refuse delivery and the letter will simply be returned to you. He can say it wasn't served, and he could have evidence of that courtesy of the return of the letter to you.
So the only way around all of that is Special Delivery then - as it'll show he rejected it
  • As well as the original thread about the fault you have another thread started for the letter https://forums.moneysavingexpert.com/discussion/5861063/finding-out-where-a-1st-class-recorded-item-is.
Can we expect a fourth thread for the stamp purchase?

    Exactly.

You're ultimately relying on the guy at some point not wanting to be bothered with the hassle of being pursued through the courts and paying up.

He might do, but likewise he might dig his heels in and fight it. He might not even bother turning up, and then you're in to the realms of trying to pay bailiffs or similar to recover the monies.

BUT, i've had success with a LBA and the threat of court action. Getting that far is free and the O/P can reassess from then

All this talk abut postage and refusing to accept a letter - how difficult/easy is it to hand deliver the letter?

Then you've no proof you did? Unless you get the guy to pose for a selfie when you're there?

As i've said already its simple, post two -
    • Post one with proof of posting only
    • Post one Special Delivery / tracked.
