Well who would roll over so easily?BUT no matter how it gets to court, the seller could fight it, and even if you win, that doesnt mean anything other than you have the right - at your expense - to pursue him for the money.
My guess is they will fight it as long as they can, in which case, if he doesn't want to issue the refund then who's physically going to make this guy?0 -

Exactly.
You're ultimately relying on the guy at some point not wanting to be bothered with the hassle of being pursued through the courts and paying up.
He might do, but likewise he might dig his heels in and fight it. He might not even bother turning up, and then you're in to the realms of trying to pay bailiffs or similar to recover the monies.
BUT, i've had success with a LBA and the threat of court action. Getting that far is free and the O/P can reassess from then0 -
