Wife received a postal PCN from Parking Eye as keeper of a vehicle.

£70 charge for parking without an appropriate permit/authorisation in a staff car park. £35 if paid before 30/06/2018.

Wife pays for an annual fee for staff a staff parking permit. She has two vehicles registered on the system but only one can be parked on any one day. Reg number must be switched online. The driver used one vehicle one day and the other the next day but my wife forgot to switch reg numbers online until the following day. Hence the PCN.

Is it worth fighting this? Wife has already complained to the her employer's parking enforcement people but was told to use the Parking Eye appeal process.

Thanks. I have. Unfortunately, I didn't see anything that specifically related to my wife's situation.

    I'll read it again.

that is because that thread (and others on here) dont deal with the "personal situation"

that thread deals with appealing and complaining to the landowner or MA about private parking charge notices

post #1 should have stated that you had read that NEWBIES FAQ before posting

only a judge in a court of law (small claims court) can sort out the legal aspect of this "situation" , which is a long way away at the moment

the university should have quashed the ticket as they are jointly and severally liable for the actions of their contractor, and de minimis applies here (its a simple mistake that hasnt cost anyone anything at all)

the PE system can easily tell from ANPR which vehicle was in the car park , so there is no reason why both cannot be "whitelisted" , because the system only detected one of two on that day

the only question to decide is , will you or her take it all the way on a point of principle ?

PE have 6 years to try a court case, like they did with BEAVIS (a different situation)

Yes as said the uni is jointly liable for their agents.

Do you realise that Parking Eye is the most complained
about scammer where the media, social media and TV
    are concerned ?

Does your UNI know this and do they also know that you
could involve them in any court action to explain
    their actions ????

A little word in their shell like ear might help to get
    this scam charge cancelled

Understood. That is quite helpful as I have been trying to encourage her to take a stronger stance with the university.

Just do it, it will be the first UNI to appear in court
    with a parking scammer

Thanks to all that have replied. It has convinced me that it is worth fighting. The problem with my wife's original appeal to the uni was that she only had a faceless help desk to deal with. I've now found out who has overall responsibility for parking enforcement. A man with a face, phone numbers and an personal email address.

she needs to explain that 2 vehicles VRM details are on the PE whitelist and only one is used on the uni premises at any one time, so the charge should be cancelled because a person is paying for one space and only one space was used by one of two authorised vehicles that are on the system

the PE system will have only recorded one vehicle entering and exiting on that day so at no time was another space being abused

plus this is classed as a trifle, de minimis , the law does not concern itself with such minor matters

both cars should be on the whitelist and its a matter for the contract that only one is allowed to park on site at any one time

the uni will have a contract in place that allows this MR BIG to cancel the charges , whereas the so called "help desk" should be relabelled as the "fob off desk" (where the person on the end of the phone cannot be ar**d to deal with it)

I suggest that you and then your wife watch and read the below to further understand the national disgrace that this scam is ...

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

Unworkable and cumbersome system - can be argued as unfair because it would be simple for PE to simply whitelist both vehicles. But you need more than that at POPLA stage, and are best to up the ante with a complaint. The Uni can certainly cancel any PCN. One email, job done.

Did the PCN arrive by day 15, and does it have the POFA/29 days words on the back?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
