Is there any terms to be aware of in the tp1 form when purchasing a freehold?

I am purchasing my freehold and there are many terms that I do not understand in the tp1 form. Is there anything in particular to be aware of?
I would be very grateful for any advice.

    To start with, why a TP1 not a TR1? More complicated.

    Are you doing the conveyancing yourself?

    If yes, stop as you clearly don't know enough and a public forum is not an alternative to professional advice

    If no, pop in and speak to your solicitor - he can see the TP1 and we can't! (plus he's a professional).

    Without knowing what 'terms' are in your TP1 and what covenants effect the freehold title (or at least the part you are purchasing) it is impossible to tell. I assume you have instructed a solicitor and aren't attempting to do this yourself?

    Thank you for the reply. There are only four sentences in the while form. One doesn't concern me as it relates to communal areas. Two refer to the indemnity from covenants on the charges register. There is only one sentence left which refers to rights of passage and utilities to the transferors retained properties.

    There aren't any covenants stated in the form, just a statement that they will have indemnity from the covenants (if any) subsisting in the charges register.

    You need to get a copy of the title register then and see what covenants are in the charges register? You will then need to decide whether to not they apply to the part of the title you are purchasing.

    Well, we are none the wiser!

    * what exactly does the TP1 say? We can't read it from here!

    * what exactly do the covenants in the Charges Register say - Again, we can't read it from here!

    * if the Charges Register refers to another document where the covenants are spelled out in full, what exactly does that document say? We can't read it from here!

    Much as we all like helping, none of us (so far as I know) are psychic.

    I only got the form a few days ago, and I'm in hospital at the moment so can't get round to see a solicitor at the moment
  • Please, please get a solicitor to review the TP1 form and to explain the content to you, word for word.

    When I read "One doesn't concern me as it relates to communal areas", it worries me that you may not understand that despite owning a freehold house, you may still have obligations to communal areas.

    Eg. if you live on an Estate, all houses, or a combination of houses and flats, you may have communal gardens, un-adopted roads, sewer stations (this list could actually be very long).

    It is very unlikely your TP1 will have covenants/clauses within it which have no purpose.
