Arch Hall Query

Hi,
I need some urgent help.
I was bankrupt in 2007.
I like many others saw the whole PPI and didn't fully research it. i contacted Gladstone Brookes and they said as i'd been bankrupt they would put me in touch with someone else.
Arch hall contacted me and said it would not cost me anything and they would try to get any PPI owed to me but it wouldn't cost me unless i won and they#d take 30% and 5% would go to the OR.
I've received a letter today from one of 2 lenders who say i am owed £4,000 in PPI and they will send all the money to OR even though my bankruptcy is long finished and the claim was not against the banks in question. These loans were paid off years before I went bankrupt.
i now have checked online and see that Arch hall could be still billing me over £2,000 and I'll be in debt to them.
I've not received the monies yet. but i did sign something from Arch hall but it never said I'd have to pay unless I got the PPI.

Help i'm getting really scared is there anything I can do?

    If you have evidence that you told the Claim firm you were a Bankrupt and they still went ahead with the PPI complaint then you should contact the Legal Ombudsman.

    If you didn't inform them you were Bankrupt then you're very likely going to be liable for their fees, I'm afraid.

    PPI redress is a pre-bankruptcy asset that belongs to the Official Receiver for redistribution to your former creditors, so it's not surprising that the Bank's concerned are paying it all to the OR.

    It does not matter that your Bankruptcy is several years ago, this is the situation forever. It also doesn't matter one jot that those Banks were not involved in your bankruptcy.

    Bankrupts have no right to any of the money unless all the creditors left unpaid have received payment in full.

    You have been missold by Arch Hall.

    One of the biggest risk warnings given on this site and other consumer sites is to never use a claims company if you have arrears, defaulted or amounts written off as you may not receive the money but will end up owing the CMC their cut.

    However, you should be ok if you raise a complaint to the claims company saying they have missold you. They should never have taken you on knowing that the PPi premiums were paid prior to bankruptcy.

    i suggest you do not use another claims company to put in a complaint against this claims company.

    Who i do complain to?
    They knew full well as they stated on the phone they only deal with bankrupts which is why they only pay out 5% to the OR and as my bankruptcy was so long ago it wouldn't affect me.
    I'm trying to get financially straight and really don't need a further debt especially because i've done over.

    How can i prove on a phone call to me that I said I was bankrupt and they said it's not an issue?
    There is nothing on their paperwork that says it. But I'd never even heard of them, it was only because Gladstone recommended them that I even talked to them. Surely these companies should be closed down?
    Guess I'll have to go to court cos I'm not paying them anything.

    Oh dear.
    Make a formal complaint anyway to this company (only if you receive a bill of course) and if you get no satisfaction refer your concerns to the Legal Ombudsman.

    While there are still people so easily duped, I'm afraid there will always be those attempting to take advantage. Do remember though that you sought them out, not the other way around.

  • After Talking with the Ombudsman and the OR directly i am not in the wrong at all and will not have to pay anything to anyone.
    I have also reported them to the claims company regulator who are aware of them.

    It's not technically the case that you are "not in the wrong at all" because, as a bankrupt, you should not have been making a PPI complaint in the first place. The redress belongs to the OR for redistribution to your former creditors.

    However, I'm happy to find that you will not have to pay the Claims Company which deceived you.

    Incidentally you have no authority to "close" this thread I'm afraid and other posters will still be free to comment here...

    The outcome is correct as you were missold by the CMC. The minute they knew you were a bankrupt, they should have ended it there telling you that you would not get a penny and should not employ them.

    As someone recently said... a certain claims company with a jingle that rhymes with "bunch of crooks"

    At least they are not based on Swansea (scam capital of the UK).

    omg I have just read chipaway1 and that's exactly what's happening to me but wheen i rang gladstone brookes last year they sent ne paoerwork i filled in sent off then months after got a letter to say archhalll took over as it was a bankrupty never heard anything still and just had text messages someone else took over rapid response and I've to ring them if my creditor gets in touch with me but I've never been told I've got any money or how much and I've tried ringing but can't get through I just want to cancel it as too much trouble but where do I stand with this please as moving house
