Money transfer from credit card to pay trader

I've been ripped off by a roofer I found on ratedpeople.com. I've been to the CAB and they have passed my details on to the Trading Standards but have told me that this will not resolve my problem and I'll need to go down another route. Ultimately the job he did on my roof hasn't worked and it's leaking and looking worse than it ever did before he got his hands on it. He won't come back to honour the 15 year guarantee he gave me.



As he was a sole trader I couldn't pay him via the credit card because he obviously didn't have the facility to take the payment. So I completed a money transfer from my credit card to my bank and then made a bank transfer to his bank account the next day. I've contacted Virgin Money and they have told me that the link is broken and I won't be able to claim under section 75.



Is this absolute or are they just trying to get out of it?

  • 100% no section 75 I'm afraid, you paid him in cash regardless of where you got the cash from.
    I'm afraid a "15 year guarantee" should have set alarm bells off.
    How much was the bill? I'm thinking small claims court?

    £950.00. It could end up costing me more to go to small claims.


    When Virgin Money replied to me they said:

    Nothing.

    You've effectively paid in cash, so small claims is your only option .

    Why would it cost more than £950 to take it to small claims court?

    It is your only option if you want to take it further.

    Because the OP will have to pay court fees to start the claim, but I agree that it is the only option.

    It won't cost more than £950, but it'll certainly cost a few hundred if it goes to a hearing and enforcement action.

    It's the only option I'm afraid as his bank won't be able to help. Do you have legal cover on your home insurance? I'm not an expert but it's possible this may cover disputes with traders who've worked on the property.

    Thanks for your replies. I've been reading up about small claims court and it looks costly and very time consuming.



    I'm going to walk away from this one, no matter how painful it's been to my pocket. I haven't got the energy; I just want my roof fixed and to be able to move out of here.
