    This is helpful too!! I knew about the 10 minutes to leave and even found reference to that in the BPA COP - are you able to point out the 10 minutes to park in the BPA COP as I have not found that...?

    13.2 If the parking location is one where parking is normally
    permitted, you must allow the driver a reasonable
    grace period in addition to the parking event before
    enforcement action is taken. In such instances the grace
    period must be a minimum of 10 minutes.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    No, you can't. You told us it was received in time and has POFA wording, so saying there is no period of parking is a nullity IMHO.

    Stop grasping at straws and simply follow what's already in the NEWBIES thread.

    Why can't your wife ask her friend in Uckfield to take a copy of the PCN in and get McDonalds to cancel it? She can say she was a member of the party that spent £xx and wants it cancelled.

    I can certainly try that I guess, it would be in her interest to as they received the same PCN as us. My wife's friend is not someone I think who would particularly excel at confrontation though... And I doubt anyone has receipts, though perhaps bank statements would suffice? There is also a good chance I think that the car park is one of those 'nothing to do with McDonalds' affairs, as it's for a retail park. She may refuse the request entirely, but I'll ask.

    I am trying to follow the advice in the NEWBIES thread to the best of my understanding. I'm sorry that I appear to you to be 'grasping at straws', that was not my intention obviously. I'm thankful for all the pointers given to me in this thread and the NEWBIES guide thus far and it has all helped me to get to this point with at least a basic understanding of what I'm up against.

    I've used the first appeal template and received the POPLA code, and now I'm trying to form a robust POPLA appeal which is why I really wanted to assert the No Keeper Liability point. If you don't believe I can argue for that, then if I understand correctly I should simply proceed with all the other raised points (Signage, Landowner, CoP Grace Period breaches, Beavis etc) in my POPLA appeal, yes?

    Or am I missing something else from the NEWBIES thread?

    Ha! So I saw it but the legalese confused the hell out of me. I can now see on reflection how it is talking about 'before' parking. THANKS

    So the wife's friend came through!!

    A staff member in the business she owns also happens to work at this particular McD's, so they rang their boss and got her a meeting. They've said they can't help now until her appeal with MET directly is rejected (?) but once she's got her rejection letter she's to go back with that (and ours) and the boss will then e-mail someone on our behalf about it to try and get them canned.

    So, potentially...Yay!?

    fair enough , but YOU still need to ensure that the popla appeal goes in by day 28 (day 33 at the latest) - regardless


    that way , if MET dont wish to contest it they will tell popla that


    so do not miss appealing to POPLA , regardless , especially when you have the GRACE PERIODS (plural) arguments etc to fall back on

    Sent in the POPLA appeal last night in the end, as the wife's friend started ignoring messages about this topic.

    I'll let you know how it turns out, and if successful post it up somewhere appropriate.

    P.S - the POPLA site is bloody tragic - all the 'options' presented seem set you up to fail.
