He's obviously trading. Equally obviously, he's going to be very, very tricky to sue.
Your best bet is to get Trading Standards interested. They can bring criminal proceedings, but most likely only if he has done something obviously wrong such as clocking the car. Have you checked the MOT history yet?

You are probably going to have to go to court to get your money back, so gather as much evidence as you can that he is running a business and document everything carefully.

Yes I've checked the mileage. Seems ok although did ovely 1000 miles in the last 4 months as opposed to 21000 in the 6 months prior to that0

The seller had a Birmingham city council permit pass In the that he'd accidentally left in that i gave back to him. I think it was a taxi permit although he'd said he was a kitchen fitter. I'd already Done all the paperwork and transferred the money by that point though !!!55357;!!!56853;0

out of interest has the car had a lot of previous owners? It seems to have been MOT'd every 6 months for 3 years which I assume is so it could be sold on with a fresh MOT.0
