Chances are the idiots don't even realise the OP's address is in Scotland.
  • I have spent hours and hours reading all the posts/links but it's quite confusing. The number of acronyms alone sent me into a flat spin. I have actually made 14 pages of notes - and am still struggling to get to grips with it. I'm finding it quite stressful!

Many thanks to those who are helping to clarify my understanding.

The number of acronyms alone sent me into a flat spin.

What, even though they are explained in the fifth post of the NEWBIES thread, and there are only a handful of acronyms? A FLAT SPIN - REALLY? Why do people get so stressed by this, especially in Scotland, where the advise is so simple it fits on one line of my signature below.

You are simply out of your comfort zone - but it is easy enough to suss the advice.

I recall being well out of my comfort zone when I sued Monarch for a few grand after the 'ash cloud debacle' in 2010, but I was never in a flat spin...except when we were trapped abroad with no money and no advice. Once back home, I just read the right things on the right MSE forum, made a few notes about EU 261/2004, put my solicitor right where they were going wrong (LOL, they were going to claim too small a sum, and needed it pointing out that we were also owed compensation - our case was unusual!) and we then won the case out of court, ''in full'' as Martin Lewis says. And we got money from the travel insurers as well, by taking them to the Ombudsman.

It is just a matter of reading the sticky threads.

What are you struggling with? Ask and someone will help.

Which part of ignore don't you understand?
  • On the back of the form they have 2 helpful boxes-:

Liability for this charge in England & Wales
The driver of the vehicle at the time this charge was issued is responsible for payment of the charge detailed overleaf. However, in certain circumstances, set out in the Protection of Freedom Act 2012, liability for payment of the parking charge may be transferred to the keeper of the vehicle.

Guess that clarifies it for me - RK is not responsible in Scotland

    Correct. :)

    The NEWBIES thread tells you:
CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM. IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.

WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS.

The sweet sound of a penny dropping!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
