Notice of Intended Court Action (Scotland)

As RK I have now received 'Notice of Intended Court action - unpaid parking charge £160'.
I'm trying to find the section on the forum that talks about this - when I search - it keeps coming up with nothing matching. I know I've seen it but can't locate it.

I don't know what to do next - so really need to find this section!
Anyone more familiar that can help? Point me to the location?

I think as it's Scotland, I would search for the Simple Procedure as your keywords instead.

Which parking firm? Only a few try Scottish small claims (Smart, VCS, etc).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I noticed reading the thread that in Scotland they assume the RK is liable regardless of whether the driver can be identified.
  • tried 'simple procedure' 179 pages came up - pretty much all the posts!

Try simple procedure Scotland sheriff instead.

Do you have two MSE logins then? Is your 2004 one now blocked?

But anyway, Britannia have never tried a Scottish claim that I've seen.

Sounds like a Debt Recovery Plus letter.

Who sent the letter to you?

Britannia very rarely try court in England they aren't really likely to chance a trek up there.

Was this from the parking company, or a debt collector, if the latter ignore.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

Do they suggest that the registered keeper is liable for the charge, quoting the Protection of Freedoms Act 2012 as the enabling legislation?
