Parking Charge notice total £1200+

PLEASE HELP!

My company has rental vans from enterprise, i recently done 2 weeks work in London and i parked the van in a large Tescos Car Park (private land).

My company notified me they had received a letter from CP plus asking for £80 or £50 for payment within 14days.

i know i will get more PCNs come through as i parked there many more days.

there were signs saying max stay 4 hours, but we did not realise that there are cameras that track you in and out.

the total cost would be over £1200 including admin fees from Enterprise!!!

is there anything i can do, ive been told that a Penalty charge and a parking charge differ greatly, this is a parking charge.

My company have told me they will not ignore the PCN so either appeal or pay i cant afford that crazy amount of money for parking in a massive empty car park!!!

    Whatever made you think you could just park your
    vehicle on private land for ages for free ?

    The T&C's of Enterprise do state they will pay
    outstanding parking charges

    CP plus will not be interested and whilst we always say
    to check the signs when appealing, I suspect there were
    enough visible signs in the Tesco car park

    Unless someone on here has any better idea, I think
    you are stuck with this one which really goes against
    the grain on here

    Luckily we hate the scammer parking firms more than we hate selfish parking.

    Luckily again, for you, this is CP Plus. They can't hold a lessee/hirer of a company car liable and so you merely need to send the Edna Basher version of appeal each and every time. It's in the thread you read first (of course):

    Whatever you do, NO saying who parked/was driving!!!!


    Are you SURE about the figures?
    CP plus asking for £80 or £50 for payment within 14days.
    That discount isn't 40% and that will assist you as hirer/lessee, at POPLA stage, if you need to try that stage too, which involves a longer appeal.



    P.S. as an afterthought, how difficult is it to let a shopping bag*accidentally* cover your rear number-plate when you leave...use your imagination. Pop socks stretch well... Think about it, or park elsewhere.

    Your parking was selfish and whilst we give tips to escape the scam, we do not encourage thoughtless/selfish taking up of private land bays by non-customers who then wander elsewhere.

    The letter dated on the PCN is over one month from the date of me parking, ive read that they should respond within 14 days.

    Do i have any argument that the time frame was so great?

    as its a leased (company) vehicle the timelines and rules are different than if it was your own vehicle


    read the EDNA BASHER explanations on lease/hire/company vehicles and what is required when a leasing company passes on the lessee/jirer details


    ie:- its not as simple as you are making out, because the vehicle is not yours


    also, as you seem to be admitting that you were the driver, the timescales are irrelevant from a drivers perspective


    the PPC has 6 years to take a driver to court
  • Apologies I can’t see how to start a thread or ask a question so I’m on this one as my q is similar.
    Had a PCN on 29/4/17.
    I wrote back challenging (parking in a restricted street during prescribed hours - had parked on grass by house) and not heard anything since.
    Apparently a Notice to a owner was served on 6/10/17 though I didn’t receive this.
    I have now had a charge certificate through the post.
    Any ideas on challenging or should just pay?

    delete your post after starting a new thread using the red NEW THREAD BUTTON on the top left of the main forum and copying and pasting your query into your own thread

    also add details of the timeline, the details on who sent you this pcn (name of parking company) - or if it is from the council ?

    ie:- nobody is going to reply to your post due to the fact you have hijacked somebody elses post who has followed the rules here, which you havent done

    so please start a new thread, or you will be ignored

    Your question could not be more dissimilar! Yours is a Council PCN.

    Hey guys

    I recently worked near a tescos private car park and i was advised wrongly to park there "it will be fine" and of course i thought after the first day or two no ticket on the windscreen im all good.

    Little did i know they catch you on camera, so i got a little PCN from my fleet manager (sent from enterprise who we of course rent our vans from)

    I parked here for 12 days so im guessing i got another 11 PCNs coming.

    I know it was my fault and i feel really stupid but the total parking charge costs and admin fees will total over £1000.

    Surely to charge a person £1000 is abit excessive!

    I really cant afford this i'm just a humble builder

    Im thinking to send the template to CP Plus to get them to correspond directly to me and appeal on the basis of poor signage which is very true, the signs are like 10 feet up and apart from the MAX 4 HOURS the T and Cs are very small.

    I'm thinking to use this template:

    Dear Sir/Madam
    Re: PCN No.
    I challenge this 'PCN' as lessee of the car and subsequently request all future correspondence be sent directly to myself at the address listed below:

    My street
    My Town
    My Postcode
    I am the vehicle's hirer and keeper for the purpose of the corresponding definitions under Schedule 4 of the Protection of Freedoms Act 2012 (POFA) now it is proven that in this instance, the registered keeper is not the "keeper" (as defined under POFA), Civil Enforcement has no reason to contact Lex Autolease again regarding this PCN

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either offer me a POPLA code or cancel the charge.

    Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.
