How do ParkingEye get away with it?

Hi All
1) I accidentally parked too long and got a "fine" from Parkingeye. I decided to ignore the £100 charge as I thought it was ridiculous. (I've never had a parking ticket / speeding ticket etc, I'm very cautious.)
2) Then I got a letter telling me they were going to court.
3) About a week later I wrote to them asking for them to be lenient, due to mitigating circumstances.
4) The next thing I get isn't a reply (sympathetic or otherwise) but a CCJ! And a demand for £175!
I didn't even know there was a court date set.
Am I being stupid? This is way out of my field of experience. It seems this was deliberately sneaked up on me by ParkingEye just to get their cash.
Is there anything I can do, that doesn't cost a fortune? Or will I just have to take it on the chin?
Thanks for any help

if you have received a CCJ then you can try for a set aside for £255
see the NEWBIES FAQ sticky thread post #2 for details, and google of course
OR
if its an MCOL that you have , then also read that same post about fighting it
google BARRY BEAVIS and his 3 court losses against PE some 2 years ago to find out "how they get away with it"
also , if replying , be specific as to if you have a CCJ and the date of the CCJ , ie:- are you within the one month payment period ? or not ?0 -
Unfortunately, these days, you can't just ignore it; you have to follow the process to contest it.Hi All

If you continue to ignore and they take it to court and you don't contest it, then they will win.
OTOH, follow the guidelines here...
(I know it's a pain, but you've no choice in dealing with these scum.)0 -
Have you definitely got a CCJ or have you just received the claim form?0
-
Does this ccj say at the top "Judgement for Claimant (in default)" or does it say something different?0

That’s what it says. I already had the claim form, which led me to write to them.
From the replies here and other sources it looks like I’ll have to pay within a month so it doesn’t stay on my record for 6 years.0 -
well it seems they "get away with it" , because at the point of a claim form , you pay up or fill in paperwork and sent to the court , and fight them
not write back to PE and try to argue , when a MCOL is sent its to late to start appealing/begging
and its a month from the default , not the date you received the above letter0 -
"They" get away with it because the law allows them to. Ignoring or, or using mitigating circumstances don't work so the only way to beat the scam is to appeal before it gets to court.
If every one of the 5.5 million people who got a PCN in the last year appealed and complained to their MPs and landowners, it would make it much harder for the scam to work.I married my cousin. I had to...I don't have a sister.

“argue” “appealing” “begging”
Your inflammatory language gives you away.
I asked them to consider leniency due to circumstances you know nothing about. I believe any reasonable person would have shown leniency after understanding my circumstances.0 -

They 'get away with it' because everything you could possibly have done wrong, you did do wrong.
Why on earth would you write to PE when you have an official document from the Court Service, stating that you have 14 days to respond? Which part of that did you not understand?
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
If you don't tell us, how are we to know, so don't get all uppity about it.I asked them to consider leniency due to circumstances you know nothing about. I believe any reasonable person would have shown leniency after understanding my circumstances.
As has been pointed out, once a court claim is issued, you have to go through the process and get legal with them. Too late for anything wishy-washy by then.0
