Hi all,
I got another letter that says my appeal has been rejected as there were signs that say cars must be parked within bays etc.
It says I can:
1.pay £60
2.appeal to the POPLA
3.ignore and it will be passed to debt recovery and pay £100 plus another £60 and court fees.
I also got my complaint to IBIS rejected.
I am getting a little upset by all this now and don't want the hassle, but I am still outraged by the 'charge'.
What would be my best course of action?
Sorry if I haven't found a similar thread, but the forum is huge.
I should add that I did park my car at an angle slightly across the white lines while I went to check-in (after a long drive - I was tired and in a hurry), but it was only for around 10-15 minutes. There is a photo of this on my original 'charge'.
Would this make a POPLA claim no worth doing?
Many thanks0 -

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -
Thanks.
I am still unsure whether I should do the POPLA appeal or just ignore the latest letter.
What is likely to happen next if I just ignore it again?0 -
do the popla appeal, otherwise you may well face a court claim within 6 years in your local county court (an MCOL)
the NEWBIES FAQ thread tells you that the initial appeal normally results in a popla code, which is what you want so you can try to squash it at popla
the vast majority who appeal go to popla once the initial PPC appeal has been rejected0 -
Thanks. I did get a POPLA code.
Is there anything that I must include in my appeal to have the best chance of winning?0 -
yes, all the lagal points where you may win on a technicality , same as is in post #3 of that NEWBIES faq thread you were asked to read in post #2, plus anything else seen in recent popla appeals in other similar threads from this year, plus anything you find by reading the POPLA DECSIONS sticky thread at the top of this forum (starting on the last page and going backwards) and reading the appeals they made to popla that resulted in a win
research , research , and more research, its all been done thousands of times before, there is little or nothing new in this topical field0 -

I have just read a POPLA win thread and noticed that it was won on the basis that the NTK was sent a long period of time after the parking event in question.
My NTK arrived with the date 05/06/2018. and with the parking charge date 01/03/2018 stated clearly on the NTK.
I assume my POPLA appeal should be a straight forward win with these facts?0 -

Only if they don't know who the driver is.
Was there no windscreen Notice to Driver?
Yes you can send a one point appeal if you are feeling brave, but it might be prudent to use all the other arguments available - as suggested by Redx two weeks ago.
Don't miss your appeal deadline date.0 -
There was no windscreen notice on the car, though they took a picture of one that they removed.0
