County court claim
Comments
-
Hi All,
i have my court date in a few weeks. please can you let me know if there is anything i need to do in preparation for this?
Thanks0 -
Same reply!
#2 in the newbies FAQ thread covers Court process right up to the hearing0 -
Thanks, that whole thread confuses me! too much to take in.. I think I must've missed that part.
I have a few questions I hope you guys can help me with.
firstly, is there any deadline the claimant has to meet in order for them to submit their evidence as I've literally received their Witness statement 1 week before we are due to go to court.
also, I have notice they have clumped together some information in support of the claim that isn't even from my case!! they have included a copy of someone else's letter with a different PCN, vehicle registration, address. isn't this a breach of GDPR?! they are obviously dealing with so many cases there not even checking all of their evidence before submitting it!!
I didn't submit any photo evidence to support my claim. should I bring this to court with me? I have bank statements, photos, videos etc. I would like to bring but don't know the process. can I also ask if someone can come with me to watch but not speak/defend on my behalf just be let in as a spectator?
finally... please can someone link me to the Beavis sign? I've looked at so many links but cant find an actual copy of it?
Thanks in advance0 -
read the BARGEPOLE link that gives a timeline of events (he posted it on here over 2 years ago, so not new, but is relevant)
also read the LOC123 link with similar thoughts
as for timings, those were on the court forms you received with the judges directions , so read those documents you received from your local court (some time ago)
yes it is a breach of GDPR, so complain to them by email and perhaps include this in any ICO complaint in the future
you cannot ambush them on the day with evidence, so get your evidence to the court asap and apologise for it being late and ask the judge to accept it
your evidence bundle needs to go to the court by the date given by the judge, your papers from the court told you this and so did BARGEPOLE in his timeline post (the one you failed to read and were pointed at)
your problem is not reading your papers properly and not reading the info in that thread you were pointed at (post #2 of the NEWBIES FAQ sticky thread) - yes we know its complicated, court claims are complicated, so dont expect the simple
look up McKenzie friend aand Lay Rep etc to see who can accompany you and what they can or cannot do0 -
It's an open court so no problem. You can also have someone attend with you in an official capacity as either a Lay Representative or a McKenzie Friend. Check the (different) role each plays via a Google Search.can I also ask if someone can come with me to watch but not speak/defend on my behalf just be let in as a spectator?
Type 'ParkingEye sign' into Google, then click on Images. You'll see loads of the type covered in Beavis. They are the yellow signs, with a few lines of t&cs and a dirty big £85 in a black box (which the Judges argued could not be missed).finally... please can someone link me to the Beavis sign? I've looked at so many links but cant find an actual copy of it?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I'm freaking out!!
I've just read - The case file will then be transferred to your local County Court, and you will eventually receive a Notice of Allocation, giving you a date and time for the hearing. It will also specify a deadline for you to submit a Witness Statement, and any other documents you intend to rely on, usually 14 days before the hearing.
I don't remember it saying anything about deadlines for witness statements and I actually don't know where I put the letter I'm praying that its somewhere in my house tonight. I cannot believe I have missed this part!!! I'm going to have to pray like you said they will forgive me for submitting my evidence late as Gladstone's send theirs to me on 16/11/18.0 -
perhaps you have not received the NOA ?
if you have any letters with the court date, from your local court, that letter should be the NOA and have the judges directions on it
in any case, the BARGEPOLE linked timeline you have been pointed to numerous times also tells you stuff like this
seems to me that the claimant is doing their part and you are not, same as this thread here

Same as all the other posters who did the same as you - this is why we want people to read the NEWBIES thread advice early.
Search the forum for late Witness Statement (show results as POSTS) and you will see people who still won, even when filing & serving a WS just a few days before the hearing. Not good, not to be encouraged (and far too common!) but you MUST do this pretty easy stage this week, to put this bit behind you and breathe!
Did you read bargepole's reported win v UKCPM today, close to your thread on the list right now?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hey,
I've found the NOA. its scheduled for 5th December. (I obviously didn't read the whole document) they have asked I deliver copies of all documents to the claimant and court office no later than fourteen days before the hearing (that's tonight) I have bank statements I need to print, photos and emails I need to collate and a job to go to tomorrow this will take me at least tomorrow night to complete.
thank you both for your advise I will read them and get back to you (with more questions probably!)0
