    In parallel you have contacted the Management Agent and Freeholder to try and get this cancelled at source right? Do you know who they are / have their contact details?

    To be honest I found a lot of dead ends when I tried that route. I contacted the site manager who told me UKCPM tell him to stay out of it.

    He did mention i should contact the directors but didn't leave contact details and I wondered how responsive they would be anyway...and to be perfectly honest I expected UKCMP to be a lot more reasonable and never expected it to get this far... I had a permit after all.

    But thanks for reminding me, I will definitely revisit that idea and try the general email address on the estates website. Maybe it will have more of an effect now it's at court stage.

    Do you all own the freehold of your estate?.

    It's just that your use of the word directors leads me to think you might. If you do then the directors will be fellow residents and may be more sympathetic than, say, an absent freeholder. We own our freehold and, as a director, I'd definitely be listening to you.

  • I'd Delete 5.3 which admits at least SOME obstruction. If their photos aren't yet before the court don't flag them - unless you want to say that pre-action you were supplied with photos that demonstrate a dash permit was displayed.

    You can critique them later in your statement by positioning the permit in the same position and taking a photo from a range of angles to illustrate the point.

    That's what I'd do.... But if course it's your case...

    Unfortunately not, or not that is clear in my contracts. And according to companies house the many directors are all over the place.

    Court claims are a way of getting someone's attention for the small sum of £25. Why not send the SM a letter before claim and then a claim.

    Time is money so it is a small amount in relation to your time, and they have to do the work. Use tortious interference, harassment and misuse of personal information by UKCPM which they have allowed by failing to do due diligence.

    Dont use "due" diligence, state reaonsable skill and care, as thats a far easier standard to prove they ffailed on!

    Thanks all - I have sent a strongly worded e-mail to the site e-mail address explaining all of UKCPMs tricks requesting for it to be cancelled. Let's see what they come back with before I start taking on more court documents!


    Question - if they cancel this, can I still request costs? It doesn't deter from the fact that I have spent a lot of time and resource on this - and as you say IamEmanre time is money.

    Oh - update. I received my e-mail back, the e-mail address does not exist.


    I will have to find a way to contact somebody but this could prove difficult so relying on my defence!!
