suppose I have to wait and see what my solicitor advises. buyers are really disappointed to. so frustrating considering I sold as 3 bedroom and not 4.. don't get me wrong I understand why it can be an issue. but the work was done so long ago I can't understand how it's an issue0

Could you give some more detail?
How does the lender know about the lack of building certs?
Are you absolutely sure the lender is requiring this |(rather than being some game by the buyer)? Your solicitor could request formal confirmation of this - or even copy of written request from lender.
You could get (a) indemnity insurance and/or (b) structural survey rather than go through application for retrospective consent. The latter may very well require you to bring up to current standards.
Whatever you do, be sure the local authority isn't informed of the situation at this point. If you don't trust the buyer, get an indemnity policy now, to cover costs of dealing with an enforcement action from the local authority. Once LA is aware, all bets are off in terms of indemnity insurance.
If the lender truly is requiring retrospective consents, you could suggest the buyer finds a different lender who would accept an indemnity policy. Another reason to get an indemnity policy now, while you can. Once someone calls the local authority, the shitstorm begins.(Nearly) dunroving0 -
Hi there, yes defo the lender requiring that on the recommendation of the surveyor they appointed.
I defo trust buyer they don't want all this hassle. Is an indemnity policy normally acceptabl? The thing is we're both using same mortgage provider so hoping this will have positive bearing, as my sale is also dependent on my new mortgage with them

If the house is deemed unsafe because it does not comply with fire safety standards the house buyers will not get a mortgage. I am just a Google expert, maybe others can add further comments.0 -
The main point to be considered here is that you have made structural changes and that needs local authority approval. When you extend your property you need to acquire planning permission in your case from 3 to 4 bedrooms I guess. You can get the help of a local solicitor or a building contractor to look into the technical details and he can help you in the best way. Take care
