Court Claim received from Gladstone on behalf of PACE Recovery

Thanks KeithP, I have done that and filled this in and will be posting this across.
Two further updates.
1. I have received the questionnaire from Gladstone and they have indicated a request for special direction. I have updated s D1 to include the following per directions from the NEWBIEs thread
"the Defendant oppose the claimant's request for special directions and requests that the case be listed for an oral hearing at the defendant's home court"
(note - I actually ran out of space as I could not fit this in the box, is this an issue or should I re-write on a fresh print out).
2. Gladstone have also sent a letter and have indicated that they would "be happy to listen any genuine payment proposals".
I've read through the example response below: https://forums.moneysavingexpert.com/discussion/comment/73000370#Comment_73000370
- My question here is it too early to respond to Gladstone and proposing their client offer money (or should I not respond at all)?
- in addition the template is quite tongue-in-cheek, is there a toned down version anywhere?0 -
1. Why not fill in the DQ form online at the link I provided?
Should be able to get the text in the D1 box that way. Then print to file/pdf.
2. That draft reply is written by a practising solicitor. Feel free to use it or not.
Firm responses are often called for in this game.0 -
Thanks again KeithP.
I shall do that now0 -
I have received a letter from the local court indicating that the claimant must pay the £80 fee by 8th Nov for the case to be heard in court.
In anticipation of this I wondered what my next course of action should be.
Should I draft the letter of rebuttal per below: https://forums.moneysavingexpert.com/discussion/comment/73000370#Comment_73000370
or should I ask Gladstone for the relevant evidence, eg contract with the landowner - also what other items should I request (should this be better approach)?0 -
I note the below in DoaM's letter:
"In comparison, all your client has done is to file a claim so brief that it verges on being incoherent, and a Directions Questionnaire. Your client has ignored the court's order to serve its witness and documentary evidence, which were due on x date, and it is therefore in contempt of court. The final hearing is just 11 days away - as a litigant in person your client's conduct is causing me significant prejudice and will draw this to the court's attention."
At what point does the court ask the claimant to share the documentary evidence? I assume this would be once a date is fixed? In which case i should hold out sending a letter to Gladstone?0 -
Can this be done online? Also what exactly does the questionnaire entail.
Thanks for asking. Answers in the Newbies thread.

DItto the query about exchange of documents - once you have a HEARING DATE you will know this, exactly as post 2 tells you.0

Hi all,
So I have a court date booked for the 6th dec (2 weeks away), however I have not received any comms from Gladstone apart from a letter asking to confirm my address. Is there a generic template I can use to request the relevant information?
Thx0 -
Have you filed your Witness Statement and evidence with the court yet?
What date did the court give you when that must be done by?0 -
I have not yet done this.
I don't have an indication of when this was due by, but I'm assuming two weeks before the date? I only found out the court date today when I called the court to ask for the date and directions letter, which was sent in Sep and resent on the 8th (but have not received)0
