UKPC - Multiple Parking Fines

Hi guys,

Just wondering if you can give some advice.

I've been living at my current residence for 12 months now with 0 issues with UKPC until the past 2 days. During my time here, I've not had a permit as it was never mentioned to me by my estate agents.

Yesterday I received a parking fine from UKPC for not having a permit displayed, OK, time to talk to the estate agents and get a permit I thought, either way I appealed it and stated that I am a resident and have been for 12 months, here is my contract and proof of address.

I thought that would be the end of it until I get my permit, but turns out today I got another parking fine for the same thing. I assumed that once a fine is issued they won't keep issuing them, but looks like I was wrong.

Is there anything I can do to prevent further charges while I wait for my permit? There is no where else I can park apart from my assigned space, but if I'm going to keep getting parking fines for the next few weeks its going to become very expensive!

    Can you not look at the signs were you park to see what the parking conditions are - assuming your renting what does your tenancy agreement say about it.

    If you're renting a flat, what does the rental agreement say about your rights to park?

    Hey,

    There isn't anything in the contract that mentions parking rights. I have no issue with the first ticket, its understandable. But its the ones that are bound to keep coming that I am going to have an issue with

    They are not fines.

    If there is nothing in your lease about parking, then there is nothing in your lease allowing a third party to charge genuine residents. Consequently you saying you don't have an issue about the first PCN doesn't make sense.
    You should be absolutely livid that a bunch of scammers who were caught doctoring time stamps on photos and were twice banned by the DVLA from getting keeper data, are scamming you.

    If/when you get a PoPLA code, you should use all the template appeal points available to you from post 3 of the NEWBIES.

    Appeal each PCN that you get, and submit a SAR to both the scammers and the DVLA about each and every PCN, using the information from the SAR fightback thread beginning "2018 June ..."

    Complain to your landlord, and complain to your MP and Sir Greg Knight MP about this unregulated scam.

    These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

    How was the flatbadverised? When shown it what did you ask about Parking? What was promised?
    Why on earth DONT you have an issue with th first? It's not understandable at re trying to charge you to park. In your spot!

    I guess it doesn't really matter what was "promised", its what in writing that counts, right?

    It was advertised as having one allocated parking spot (as evident by the number on the spot too!), as I said, been here for a year without any issues previously.

    The reason I don't really have an issue is because there are signs up about needing a permit, I've seen them, I've acknowledged them but since it had been 12 months without issue, I thought I was above them, now its come to get me!

    These companies are scammers, and ex clamper UKPC is one of the worst.

    It is very unlikely that by parking without a permit you breached a contract with UKPC, your AST will usually give you an unfettered right to park. Google Primacy of Contract.

    Is the parking space allocated, or does your landlord own it?
    You never know how far you can go until you go too far.

    A scammer puts up a sign saying you need a permit, when your lease/tenancy agreement says nothing of the sort?
    I really, really, really don't understand why you don't have an issue with that.

    I would be absolutely incandescent with rage if a scammer demanded money with menaces to park in my own parking spot.

    The sign has always been there, my estate agent is currently in talks with my landlord to get me a permit issued.

    As far as I am aware, is its allocated, but if I'm honest I do not know if the landlord owns it.

    Is there anything I can do to prevent getting ticket day after day?

    You seem to have accepted these ex clamping muppets that were investigated for fraud, incentivise their attendants against the rules, falsify time stamps on evidence, and have been banned twice by the DVLA are in the right, so what do you think about preventing any more tickets?
