Evicting adults in my home

I separated from my girlfriend last October. We had bought a house 9 months previous and were completely 50/50. We have a very small mortgage on a large house. She has lived there ever since (9 months) with her 2 daughters (both earning adults) aged 30 and 25 both paying her keep of around £200 pcm. She is unwilling to be reasonable on selling the house and lives there very cheaply while all I want is to sell the property and split the proceeds. Do I have a legal right to evict the daughters in order to force my ex girlfriend to want to sell the property and move on. She has offered to buy me out for less than 30k of the value. I know I can take her to court to force a sale but will be very expensive and want to try other avenues first....help!!

I hope she's paying you market rate rent for your 50% of the house.0

She is not paying me anything... I have stopped paying the mortgage which is under £300 pcm...I would just like to know if I can evict her adult daughters as we should have to agree jointly about anyone else in the house...for example when she agreed to market house she has asked the estate agent to market at a very inflated price hence no offers and only 4 viewings in 4 months all of which said the house was overpriced but to reduce the price we have to agree jointly and she is unwilling...0

Either:
1. Make sure she is paying 50% of the market rental price for the property and that you are both still paying the mortgage 50/50.
2. Move back in.
3. Inform her that unless she agrees to sell, you will force the sale of the house and go down the legal route, where she will then be made to deduct all legal expenses from her share.
4. As 3 but agree to pay legal costs if she agrees to sell but you want the house on the market in the next 4 weeks.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

I don’t think you can evict them as such, the other owner has given their permission for them to live there and has as much right to do that as you do.
I wouldn’t move back in, that’s just a recipe for conflict and misery, I would get to a solicitor and start the process for forcing a sale.0 -
Thing is it is on the market at an inflated price....if I go down the solicitor route and ends up towards court she will probably turn round and reduce the price eventually meaning I have to pay the costs for a lawyer up to that point....0

Thing is though, you can!!!8217;t just make people behave the way you want them to, that!!!8217;s why there are solicitors and laws for when you need to force the issue!
If she won!!!8217;t sell unless you shell out for legal costs to put pressure on you may as well just do it first as last.0 -
No you can't evict them. She is part owner so can have whoever she wants there.
you could demand 50% of whatever rent they pay - but good luck extracting that.....!
Similarly you could demand she pay you rent for occupying the 50% that you own. again - forget it. A long pointless fruitless attle.
As others have said, threaten the legal route to force a sale, with her bearng the ultimate legal costs (which could be considerable and slow).
Hopefully she'll see reason, agree a sensible sale price, and allow a sale to proceed without legal action.0
