    Wrote a skeleton argument for nothing, can it not be served for the crack?
    Also discontinued with a week to go, is that not against the rules?

    Nope, they can discontinue at any time.

    I would ask for the hearing to be converted to a costs hearing. They clearly had no intention of allowing a court to examine the case, and have wasted everyones time, including yours. You wish to prsue costs pursuant to CPR27.14(2)(g). As the hearing fee has been paid, this would incur no additional RECOVERABLE cost to the claimant.

    Are there any cost implications for the defendant?
    Also, the defendant sent a cover letter with their witness statement.
    The cover letter explained that the defendant wouldn't pursue costs should the claimant discontinue.

    Does this really matter?

    I hadnt realised you did that. Given how strong your hand was, seems a bit crazy to offer that.

    In the end, it was never about the money.
    Was principle. I wasn't going to be punished for something I could not and should not be punished for.

    My concern now is for other people.

    Don't know if I'm paranoid here but should I check this is genuine?
    i.e contact the court if I haven't heard anything from them come Monday?

    Cut off for skeleton is Tuesday.

    Yes of course you call the court. Never trust the claimant.

    One benefit of a disctoniunance is you avoid litigation risk entirely, ie the risk that no matter hwo strong your case is, a court can still rule against you.
