  • "Squeaked" is right. When I went to the OR's office after my hearing, my voice fluctuated between a very good impression of Phyllis Pearce & a mouse fighting for air in my throat. I had to put my hands in my lap under the table so that my right hand could hold the left & stop it from shaking. I thought I was sweating hard enough to drench a flood plain, but when I went to the ladies afterwards there wasn't a bead of sweat on me. It was all nerves & imagination working overtime. :)

    You know I watch game shows and when people win 15k I go - oh thats not enough. I used to do that, it just shows how desperate you've got and really need to solve your problem, BR will solve it..
    I think about nothing else and every time I have a break in work it comes to me. I have this hanging over me. This will pass, I'm 2 months into my BR and I now get much better nights sleep and Money isn't a problem.. ( well previous debts aren't anyway ) :j
    I am bothered about going br - I'm very bothered about the after though. The IPA or BRO or something horrible in the paper and someone mentions it to my dad in the pub - I live in the smallest place in the world and it's nosey and close and I am sure someone will spot it.I live in a small town in north wales and NO-ONE and I mean NO-ONE has mentioned it, and to be honest I'D TELL THEM TO f@ck OFF, WE'RE A BLOODY STRONG BUNCH US BANKRUPTS, HOW MANY PEOPLE HAVE GOT THE BOTTLE TO FACE UP TO THERE TOTAL DEBT AND DEAL WITH IT?????? They'd rather struggle on in an endless pit of debt and card hopping hoping they'll be able to solve it when as we know it's sometimes to difficult . I am scared and I know it's stupid. I'm also scared that they won't accept my petition. And tell me to do a DMP or something! The judge will accept your petiton, It's alright to be scared, but really it will be fine..;)

    I had debts, my circumstances changed, I tried but couldn't pay them, I dealt with them in the best way I could.........

    So you JUST take your petition and SAR at this stage? I have an EX160 form. I don't earn more than 15k and I don't know if I am exempt - should I try anyway. I do have the full £485 but it will be a push with christmas.

    They've made the exemption system for the £150 a lot more complicated recently, so it's best to ask the court staff for help.
    It still seems to vary court by court how easily you are excused the fee, so if in doubt try. :) You may be out of luck though if you are on £15K, and I think the exemption level for a single person with no kids is about £12K. (fermi hunts for the ex160a..........)

    Even if you end up paying the fee on the day, you can apply for the fee remission retrospectively to get a refund if you find out you will be eligible. A pain to have to pay and then claim back, but if it turns out you are eligible then at least it's something.

    But yes, it just the forms you need for court at this stage. WDIAG went BR at the Hight Court in London which is a special case where you see the OR the same day. There are a very few other courts around that do the same (Liverpool for one I think), but I'm not sure about in Wales. I would hope they would have told you if they do, but maybe check for peace of mind.

    I used to earn a lot more but as you know I am temping.
    Crap isn't it? That's almost as embarrassing as BR!

    So I should be able to get it but I will take the full £485 anyway.

    Your earnings aren't something to be laughed at, I was earning best part of 30K a year 2years ago and now I'm currently earning £0.... :eek:

    You should feel proud that your out there paying your way and dealing with your problems, just wait till you go BR, you'll be surprised at how much money you've got left after paying bills, IT amazes me and i'm not working! Can't wait till i'm back at work, even if i get an ipa I'll still have more cash flow than i've had in years:j

  • The form for claiming exemption (ex160) & the explanatory leaflet (ex160a) can be downloaded from here. Whether you can get remission of the fees is now dependent on you claiming full remmission based on permitted benefits or gross annual income, or partial remission based on a means test. If you're not sure of anything on the form, your best bet is to take proof of income or benefits with you to the court & ask one of the court staff to help you fill it in.
  • Thank you WDIAG - I have evidence of income and also I've filled in most of it. It would be a HUGE help not to have to pay that extra £150.
